Schools Authority (Amendment) Ordinance 1985

An Ordinance to amend the Schools Authority Ordinance 1976

Short title

1.  This Ordinance may be cited as the Schools Authority (Amendment) Ordinance 1985.1

Commencement

2.  This Ordinance shall come into operation on 1 July 1985.

Principal Ordinance

3.  In this Ordinance, “Principal Ordinance” means the Schools Authority Ordinance 1976.2

4.  Section 10 of the Principal Ordinance is repealed and the following section substituted:

Membership of Authority

“10. (1)  the Authority shall consist of—

(a)the Chief Education Officer;

(b)1 member nominated by the body incorporated in the Territory under the name of the Australian Capital Territory Council of Parents and Citizens Associations Incorporated;

(c)1 member nominated by the Australian Capital Territory Teachers’ Federation;

(d)2 members nominated by the House of Assembly; and

(e)4 members nominated by the Minister.

“(2)  the members referred to in paragraphs (1) (b), (c), (d) and (e) shall be part-time members and shall be appointed by the Governor-General.

“(3)  A person is not eligible for appointment as a member referred to in paragraph (1) (b), (c) or (d) unless the person is a member of the body or organisation referred to in that paragraph.

“(4)  The performance of the functions and the exercise of the powers of the Authority are not affected by reason only of there being a vacancy or vacancies in the membership of the Authority.”.

Term of office

5.  Section 11 of the Principal Ordinance is amended by omitting from sub-section (2) “paragraph 10 (1) (e)” and substituting “Paragraph 10 (1) (d)”.

Termination  of office

6.  Section 15 of the Principal Ordinance is amended by omitting from paragraph (2) (ab) “paragraph 10 (1) (b), (c), (d) or (e)” and substituting “paragraph 10 (1) (b), (c) or (d)”.

7.  Section 16 of the Principal Ordinance is repealed and the following section substituted:

Chairman

“16.  (1)  The Governor-General may appoint a part-time member to be Chairman of the Authority.

“(2)  Subject to this Ordinance, a member appointed as Chairman holds office for such period, not exceeding 3 years, as is specified in the instrument of appointment and is eligible for re-appointment.

“(3)  The Chairman may resign the office of Chairman by writing signed by him or her and delivered to the Governor-General.

“(4)  Where the Chairman ceases to hold office as a member, the person ceases to hold office as Chairman.”.

Meeting

8.  Section 17 of the Principal Ordinance is amended—

(a)by omitting from sub-section (2) “5” and substituting “3”; and

(b)by omitting from sub-section (5) “8” and substituting “5”.

Acting appointments

9.  Section 18 of the Principal Ordinance is amended—

(a)by omitting from sub-section (3) “paragraph 10 (1) (b), 10 (1) (c) or 10 (1) (d)” and substituting “paragraph 10 (1) (b) or (c)”;

(b)by omitting from sub-section (4) “paragraph 10 (1) (e)” and substituting “paragraph 10 (1) (d)”; and

(c)by adding at the end the following sub-section:

“(7)  In this section, unless the contrary intention appears, “part-time member” includes a person appointed to act as a member under sub-section (2).”.
