School Education Amendment Regulations 2012

Made by the Governor in Executive Council.

1.             Citation

These regulations are the School Education Amendment
Regulations 2012.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day on which the Health, Safety and Civil Liability (Children in Schools and Child Care Services) Act 2011 section 9 comes into operation.

3.             Regulations amended

These regulations amend the School Education
Regulations 2000.

4.             Regulation 148A inserted

After regulation 147 insert:

148A. Health and safety, treatment for anaphylaxis:
s. 244(2)(ba)
(1) In this regulation —
adrenaline means adrenaline in the form in which it is
identified in Schedule 3 under the Poisons Act 1964
section 20A;
auto-injector means a device containing a single
pre-measured dose of adrenaline, with a mechanism for
administering the dose by injection;
enrolled child means —

(a)

a child enrolled at a community kindergarten; or

(b) a student;

staff member means a natural person who is —

(a)

employed in the department referred to in section 228; or

(b)

employed in a school registered under section 160.

(2) A staff member may, in the course of the staff
member’s employment as a staff member, administer
adrenaline to an enrolled child by means of an
auto-injector if the staff member reasonably suspects
that the child is suffering an anaphylactic reaction,
even if there is no consent to the administration of the
adrenaline.
