An Act to amend the School Education Act 1999 and to make

consequential amendments to the School Curriculum and Standards

Authority Act 1997.

[Assented to 29 November 2012]

The Parliament of Western Australia enacts as follows:

Part 1 — Preliminary

1.             Short title

This is the School Education Amendment Act 2012.

2.             Commencement

This Act comes into operation as follows —

(a)

sections 1, 2, 3 and 5 — on the day on which this Act receives the Royal Assent;

(b)

the rest of the Act — on 1 January 2013.

3.             Act amended

This Part amends the School Education Act 1999.

4.             Section 4 amended

(1)

In section 4 delete the definition of year 11 and year 12.

(2)

In section 4 insert in alphabetical order:

final years of compulsory education for a child means the final 2 years of the compulsory education period for the child;

(3)

In section 4 in the definition of teaching staff delete

“section 236(2);” and insert:

section 236(2).

5.             Sections 5 and 6 replaced

Delete sections 5 and 6 and insert:

5.             Pre-compulsory education period

The pre-compulsory education period for a child is as

follows —

(a)

until 31 December 2012 —

(i)      from the beginning of the year in which the child reaches the age of 4 years and 6 months; and

(ii)      until the end of the year in which the child reaches the age of 5 years and 6 months;

(b)

from 1 January 2013 —

(i)      from the beginning of the year in which the child reaches the age of 4 years and 6 months; and

(ii)      until the end of that year.

6.             Compulsory education period

(1)

The compulsory education period for a child is as

follows —

(a)

until 31 December 2012 —

(i)      from the beginning of the year in which the child reaches the age of 6 years and 6 months; and

(ii)      until the end of the year in which the child reaches the age of 17;

(b)

from 1 January 2013 until 31 December 2013 —

(i)      from the beginning of the year in which the child reaches the age of 5 years and 6 months; and

(ii)      until the end of the year in which the child reaches the age of 17;

(c)

from 1 January 2014 —

(i)      from the beginning of the year in which the child reaches the age of 5 years and 6 months; and

(ii) until —

(I)

the end of the year in which the

child reaches the age of

17 years and 6 months; or

(II)

the child reaches the age of 18,

whichever happens first.

(2)

If a child satisfies the minimum requirements for

graduation from secondary school established under

the School Curriculum and Standards Authority

Act 1997 before the end of the compulsory education

period under subsection (1), this Act applies in respect

of the child as if the compulsory education period for

the child ended when the requirements were satisfied.

6.             Part 2 Division 1 heading replaced

Delete the heading to Part 2 Division 1 and insert:

Division 1 — Compulsory education with alternatives in

final years of compulsory education

7.             Section 10 amended

In section 10(2) delete “year 11 or year 12” and insert:

either of the final years of compulsory education

8.             Part 2 Division 1 Subdivision 1A heading replaced

Delete the heading to Part 2 Division 1 Subdivision 1A and

insert:

Subdivision 1A — Alternatives to the operation of section 9

in final years of compulsory education

In section 192(a) delete “the first year of ” .

In section 199(1)(a) delete “the first year of ” .

In the note under section 9(1a) delete “year 11 or 12” and insert “either

of the final years of compulsory education”.

This Part amends the School Curriculum and Standards

Authority Act 1997.

14.           Section 3 amended

In section 3 delete the definition of compulsory education

period and insert:

compulsory education period has the meaning given in

the School Education Act section 6(1);

15.           Section 19A amended

(1)

In section 19A(1) insert in alphabetical order:

final years of compulsory education has the meaning

given in the School Education Act section 4;

(2)

In section 19A(1) in the definition of student paragraph (a)

delete “the 11th or 12th year of the compulsory education period”

and insert:

either of the final years of compulsory education
