REASONS FOR DECISION
Mrs SB was at the time of the hearing 91 years old and had been residing in a nursing time for a short while.
At the time of the hearing Mrs SB’s sons SJ, SS and SK were acting as her attorneys under an enduring power of attorney. The tribunal had removed another son SW as attorney by order of 22 July 2011. There were concerns about the appropriateness of the decision making arrangements and the tribunal initiated an application for administration. Family members made further applications for both guardianship and administration.
Following the hearing of the application on 13 December 2011 the Tribunal reserved its decision. The Tribunal was advised on 19 March 2012 of the passing of Mrs SB on 17 March 2012 and not having as yet made its determination as to the appointment of decision makers for Mrs SB will dismiss the applications for guardianship and administration.
