Savfam Pty Ltd - Certified Agreement 2010.
[1] Savfam Pty Ltd seek approval of an agreement titled Savfam Pty Ltd – Certified Agreement 2010 (the Agreement).
[2] The Agreement put forward for approval provides at clause 1.5 that the agreement shall operate for a period of some five years (until 30 June 2015).
[3] This is contrary to section 186(5)(b) of the Fair Work Act 2009 (the Act).
[4] The defect is not amenable to variation or any undertaking.
[5] In the circumstances, I decline to approve the Agreement.
