48 Sanctuary Cove Resort Act Amendment Act 1986 Preamble : Whereas the Sanctuary Cove Resort Act 1985 provides for the manner of subdivision of certain land described therein as secondary lots, at Hope Island in Queensland to be by way of building units plans or group title plans: And Whereas, to facilitate the development in stages of the resort, Discovery Bay Developments Pty. Ltd., a company referred to in that Act, seeks provision for the subdivision of secondary lots by way of plans of survey before the registration of the appropriate building units plans or group titles plans: And Whereas it is desirable to make that provision: BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Sanctuary Cove Resort Act Amendment Act 1986, (2) In this Act the Sanctuary Cove Resort Act 1985 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Sanctuary Cove Resort Act 1985-1986. 2. Amendment of s. 15 . Subdivision of secondary lots. Section 15 of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:- "(2) A secondary lot within the Harbour, River and Waterfront Residential Zone or the General Residential Zone may only be subdivided- (a) for the purpose of the registration of a group titles plan or a building units plan over a lot thereby created, by way of registration of a plan of survey; or (b) by way of registration of a building units plan or a group titles plan. The provisions of sections 13 (2) and 14 apply in respect of a subdivision of a secondary lot pursuant to provision (a) as if the secondary lot were an initial lot and each lot, other than a lot constituting a secondary thoroughfare, so created shall become a secondary lot.".
