v

wESTPAC BANKING CORPORATION

[2023] HCASL 23

  1. The applicants require an extension of time within which to seek special leave to appeal from a decision of the Full Court of the Supreme Court of Tasmania (Brett J, Jago J and Martin AJ) dismissing the applicants' appeals from a decision of the Supreme Court of Tasmania (Geason J).

  2. The applications concern issues of pre-trial practice and procedure which it would not be in the interests of justice for this Court to consider. Further, the applications have insufficient prospects of success to warrant a grant of special leave. It would therefore be futile to grant the extension of time that is sought. Special leave should be refused.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the applications with costs.
