BRENNAN J:  As you can see, gentleman, the Court in unable

to be constituted by a Full Bench of three for the

hearing of this matter. That is unfortunate but it

seems unlikely that we are going to finish the list

this afternoon in any event and in those

circums_tances the Court is of the opinion that it

is bett~r that this matter should stand over until

the next sittings.

Are there any submissions to be made in the

light of that information?

MR JOPLING:  We are content with that, Your Honour.
BRENNAN J:  The Court will then adjourn this matter to be

stood over until the next day on which the Court is

appointed to sit in Melbourne for the hearing of

applications for special leave to appeal.
