An Act to authorize the Sale of certain Improved

Lands. [23rd December, 1867.]
WH E R E A S in Schedule A have appl ied to condit ional ly pu rchase cer ta in
t h e persons whose names are hereinaf ter men t ioned
Crown L a n d s u n d e r t h e t h i r t e e n t h section of t h e Crown Lands Alien­

a t ion A c t of 1861 a n d have resided on a n d improved t h e same a n d whereas t h e said l ands have been subsequent ly found to be wi th in areas reserved from condi t ional purchase on account of popula t ion b y t h e said t h i r t e e n t h section A n d whereas t h e persons whose n a m e s are

men t ioned in Schedule B have improved cer ta in un improved t o w n
lands reserved from condi t ional pu rchase by the said t h i r t e e n t h section
and no t sold by publ ic auc t ion u n d e r t h e twenty-four th section of t h e

said A c t A n d whereas t h e person whose n a m e is men t ioned in Schedule C appl ied to condit ional ly purchase cer ta in Crown L a n d u n d e r t h e said t h i r t e e n t h section and has resided on and improved the same a n d whereas t h e said l and has been subsequent ly found to be wi th in an area of a procla imed Gold F ie ld excluded by special p roc lamat ion from condi t ional purchase A n d whereas t h e person whose n a m e is men t ioned in Schedule D has been declared t h e condit ional pu rchase r of cer ta in Crown L a n d a n d whereas t h e l and so pu rchased is contained wi th in a n a rea which has since been duly declared to be set apa r t as t h e site of a t o w n a n d whereas t h e said last- men t ioned person agreed to re l inquish t he land so condit ional ly pu r ­ chased in considerat ion t h a t he was allowed to purchase t h e five acres set opposite to his n a m e in t h e said las t -ment ioned Schedule A n d whereas in or abou t t he m o n t h of F e b r u a r y one thousand e ight h u n d r e d a n d s ixty- two one George Dewdney as t he t rus t ee of t h e person whose n a m e is men t ioned in Schedule E such person t h e n be ing u n d e r cover ture applied to condit ional ly purchase w i thou t compet i t ion cer ta in un improved Crown L a n d and whereas t h e person whose n a m e is men t ioned in Schedule E a n d he r h u s b a n d have improved t h e land so applied for and whereas he r h u s b a n d is now dead A n d whereas t h e person whose n a m e is men t ioned in Schedule E has appl ied to con­ di t ional ly purchase w i thou t compet i t ion cer ta in un improved Crown L a n d h e supposing t h e said l and to conta in forty acres and whereas u p o n survey i t appears t h a t t h e said l and only conta ins th i r ty -one acres a n d one rood a n d whereas t h e person whose n a m e is men t ioned in Schedule E has resided on a n d improved t h e l and so appl ied for A n d whereas i t is expedient to sell to t he persons whose names are men t ioned in t h e Schedules A B C D E and F the por t ions of Crown L a n d s set opposi te to t he said names in t h e said Schedules respectively a t an appraised value and to give t h e requis i te au thor i ty for such purpose Be i t therefore enacted by t h e Queen ' s Most Exce l l en t Majes ty by and wi th t h e advice and consent of t he Legislat ive Counci l and Legislat ive Assembly of N e w South Wales in P a r l i a m e n t assembled and by t h e au thor i ty of t h e same as follows :—

1. The Governor w i th t h e advice of t h e Execu t ive Council may
sell a n d g r a n t t h e several por t ions of lands men t ioned in Schedules A

B C D E and F he re to annexed to t h e respective persons whose names

ively w i thou t compet i t ion in fee simple at a pr ice to be fixed by are set opposite to such por t ions of lands in t he said Schedules respect­

appra i sement in accordance wi th t h e provisions of t h e Crown L a n d s Al iena t ion A c t of 1861 such pr ice no t be ing less t h a n e ight pounds an acre for t own lands a n d one pound an acre for o ther lands b u t such

appra i sement shal l n o t inc lude any va lue for improvements .
2. U p o n t h e issue of t h e g r a n t of t h e land men t ioned in Schedule

D a n d hereby author ized to be sold and g ran t ed t he land agreed to be re l inquished shal l r ever t to H e r Majesty as fully to all i n t en t s and

purposes as if t h e same h a d no t been condit ional ly purchased .
