Sale of Hazardous Goods Regulations 2000

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Sale of Hazardous Goods Act 1977 .28 June 2000

1Short titleThese regulations may be cited as the Sale of Hazardous Goods Regulations 2000 . 2CommencementThese regulations take effect on 1 September 2000. 3Appeals (1) An appeal under section 9 of the Act is to be instituted by a notice of appeal lodged with the clerk of petty sessions. (2)  A notice of appeal is to specify – (a) the order appealed against; and (b) the grounds of appeal. (3)  On lodgment of a notice of appeal, the clerk of petty sessions is to – (a) provide a copy of the notice to the chairman of the Committee; and (b) give the parties to the appeal written notice of the time and place at which the appeal is to be heard. (4)  A party to an appeal is – (a) the chairman of the Committee; and (b) the appellant. (5)  The magistrate hearing an appeal or a party to an appeal may summon a person to appear and give evidence at the hearing of the appeal. (6)  The magistrate – (a) may adjourn the hearing as the magistrate considers appropriate; and (b) may inform himself or herself on any relevant matters in a manner the magistrate considers appropriate; and (c) is to proceed without undue formality; and (d) is not bound by the rules of evidence. (7)  A party to an appeal may be represented by a legal practitioner. 4RescissionThe Sale of Hazardous Goods Regulations 1977 are rescinded.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) prescribe how an appeal under section 9 of the Act is to be instituted, heard and determined; and (b) rescind the Sale of Hazardous Goods Regulations 1977.
