Sale of Hazardous Goods Order 2002

The Products Safety Committee makes the following order under section 8 of the Sale of Hazardous Goods Act 1977 .

PART 1Preliminary1Short titleThis order may be cited as the Sale of Hazardous Goods Order 2002 . 2CommencementThis order takes effect on 1 November 2002. PART 2Baby walkers3InterpretationIn this Part – baby walker means a device that – (a) consists of a frame on wheels designed to support, inside the frame and with the child’s feet touching the ground, a child who has not yet learned to walk; and (b) is propelled by the movement of the child; baby walker consumer product safety standard means sections 6.1, 6.4 and 9.3 of the United States Standard (ASTM F 977-00) entitled Standard Consumer Safety Specification for Infant Walkers, approved on 10 April 2000, published in July 2000 and available from the website of the American Society for Testing and Materials ( 4Condition on sale of baby walkersA person must not sell a baby walker unless it complies with the baby walker consumer product safety standard. PART 3Bunk beds5InterpretationIn this Part – bunk bed means – (a) a set of components that are assembled or are ready for assembly into single beds, or double/single combination beds, which will be stacked one over the other; or (b) any bed, other than a hospital bed, where the upper surface of the mattress base is at least 800 millimetres above the floor surface; bunk bed consumer product safety standard means the consumer product safety standard for bunk beds declared under section 65E of the Trade Practices Act 1974 of the Commonwealth. 6Condition on sale of bunk bedsA person must not sell a bunk bed unless it complies with the bunk bed consumer product safety standard. PART 4Disposable Cigarette Lighters7InterpretationIn this Part – Commonwealth regulations means the Trade Practices (Consumer Product Safety Standard) (Disposable Cigarette Lighters) Regulations of the Commonwealth; disposable cigarette lighter means a disposable lighter as defined in the Commonwealth regulations; disposable cigarette lighter consumer product safety standard means the consumer product safety standard prescribed for disposable lighters by the Commonwealth regulations. 8Condition on sale of disposable cigarette lightersA person must not sell a disposable cigarette lighter unless it complies with the disposable cigarette lighter consumer product safety standard. 9RevocationThe Sale of Hazardous Goods (Disposable Cigarette Lighters) Order 1997 is revoked. PART 5Toys for children10InterpretationIn this Part – child’s toy means a toy, as defined or specified in the toy consumer product safety standard, that is designed for a child who has not attained the age of 3 years; toy consumer product safety standard means the consumer product safety standard for children’s toys declared under section 65E of the Trade Practices Act 1974 of the Commonwealth. 11Condition on sale of children's toysA person must not sell a child’s toy unless it complies with the toy consumer product safety standard.

(a) places restrictions on the sale of toys for children less than 3 years of age, disposable cigarette lighters, bunk beds and baby walkers; and (b) revokes the Sale of Hazardous Goods (Disposable Cigarette Lighters) Order 1997.
