Sale of Hazardous Goods (Monkey Bikes) Order 2006

The Products Safety Committee makes the following order under section 8 of the Sale of Hazardous Goods Act 1977 .

1Short titleThis order may be cited as the Sale of Hazardous Goods (Monkey Bikes) Order 2006 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3InterpretationIn this order – monkey bike means a scaled-down working motorcycle that is – (a) powered by an internal combustion engine; and (b) commonly known as a monkey bike, mini bike or pocket bike; and (c) not intended by its manufacturer for certification under the Road Vehicles Certification System operated by the Commonwealth Department of Transport and Regional Services. 4Restriction on sale of monkey bikesA person must not sell a monkey bike unless it complies with the specifications in Schedule 1 to this order. Clause 4

1.   Accelerator A monkey bike must be equipped with an accelerator that is – (a) mounted on the monkey bike’s right handlebar; and (b) self-closing in a clockwise direction to the idle position when released. 2.   Braking systems A monkey bike must be equipped with a braking system that  – (a) is capable of acting on both the front and rear wheels; and (b) ensures that the braking effort applied to the control lever is equally and automatically distributed onto each brake lining without the necessity for an adjuster at the brake calliper; and (c) incorporates (unless the monkey bike has a drum-type braking system) a floating or sliding brake calliper which compensates for any increased movement of its components arising from brake pad wear. 3.   Foot pegs A monkey bike must be equipped with foot pegs, each of which is capable of holding a static load equal to – (a) the maximum carrying capacity recommended by the monkey bike’s manufacturer; or (b) where no maximum carrying capacity is recommended by the monkey bike’s manufacturer, 70 kilograms. 4.   Steering A monkey bike must be equipped with – (a) a steering head (head stem) that exhibits no free play; and (b) steering that moves freely, under its own weight, from right lock to left lock with the front wheel raised off the ground. 5.   Supplemental engine stop A monkey bike must be equipped with a thumb-operated supplemental engine stop that is – (a) located on the right handlebar of the monkey bike; and (b) clearly visible to the seated driver; and (c) capable of stopping the engine; and (d) capable of being operated through its full range by the driver’s right hand without the need for the driver to take that hand off the throttle; and (e) identified as "Engine Stop" and marked with the words "Off" and "Run", or the equivalent International Standards Organisation (ISO) symbols, clearly legible to the seated driver.
