An Ordinance to amend the Sale of Goods (Vienna Convention) Ordinance 1987

Short title

1.  This Ordinance may be cited as the Sale of Goods (Vienna Convention) (Amendment) Ordinance 1989.1

Principal Ordinance

2.  In this Ordinance, “Principal Ordinance” means the Sale of Goods (Vienna Convention) Ordinance 1987.2

Repeal

3.  Section 8 of the Principal Ordinance is repealed.

Schedule

4.  The Schedule to the Principal Ordinance is amended—

(a)by omitting from paragraph (1) of Article 32 “The” and substituting “If the”;

(b)by omitting from paragraph (2) of Article 32 “sure”;

(c)by omitting subparagraph (2) (b) of Article 42 and substituting the following subparagraph:

“(b)     the right or claim results from the seller’s compliance with technical drawings, designs, formulae or other such specifications furnished by the buyer.”;

(d)by inserting in paragraph (1) of Article 58 “the” after “either”;

(e)by omitting from paragraph (2) of Article 61 “the right” and substituting “his right”;

(f)by omitting from Article 70 “had” and substituting “has”;

(g)by omitting from Article 74 “or” (first occurring) and substituting “of”;

(h)by omitting from paragraph (2) of Article 76 “purpose” and substituting “purposes”;

(i)by omitting from paragraph (4) of Article 79 “effects” and substituting “effect”;

(j)by omitting from paragraph (1) of Article 81 “provisions” and substituting “provision”;

(k)by inserting in paragraph (1) of Article 86 “such” after “take”;

(l)by omitting from paragraph (3) of Article 94 “make” and substituting “makes”;

(m)by omitting from Article 95 “or” (last occurring) and substituting “of”; and

(n)by omitting from paragraph (6) of Article 99 “depository” and substituting “depositary”.
