SALE O F F I R E W O O D R E G U L A T I O N S .

1. These Regulations may be cited as the Sale of Firewood citation.

Regulations.

2. These Regulations shall apply in such areas as are specified Application of

3 .— (1.) In these Regulations unless the contrary intention Definitions,

" firewood " means firewood in billets or in lengths not exceeding

five feet;

" in bulk " refers to firewood which is not contained in sacks; " t h e Ord inance" means the Weights and Measures Ordinance

1929-1937, as amended from time to t ime;

" vendor " means a person who carries on the business of selling

firewood.

(2.) Any reference to a Form shall be read as a reference to a Form in the Schedule to these Regulations.

4.— (1.) When delivery of firewood contained in sacks is to be made issue of

by a vendor to a purchaser, the vendor shall issue to the driver of the rcspcctfof sacks at the premises of the purchaser, deliver the docket to him or his representative:

Provided that , where the whole of any load or firewood carried on the vehicle is to be delivered to the one purchaser a docket in accord- ance with Form B may be issued and delivered in lieu of a docket in accordance with Form A :

Provided further that it shall not be necessary to issue and deliver a docket if there is affixed to each sack, in a conspicuous place, a metal label on which is clearly and legibly marked, in figures and letters not less than one-half an inch in height and of proportionate breadth, the correct net weight of the firewood in the sack.

(2.) The driver shall, upon demand by an Inspector, produce the- docket to him for inspection and, if the firewood carried is for delivery to more than one purchaser, shall indicate the particular sack or sacks for delivery to each purchaser.

Penalty: Five pounds.

Issue of 5. When delivery of firewood is to be made in bulk by a vendor

respect of to a purchaser, the vendor shall issue to the driver of the vehicle on
firewood in
bulk. which the firewood is carried a docket in accordance with Form A and the driver shall, before unloading the firewood at the premises of the purchaser, deliver the docket to him or his representative:
Provided that, where the whole of any load of firewood carried on
the vehicle is to be delivered to the one purchaser, a docket in accord-
ance with Form B may be issued and delivered in lieu of a docket,
in accordance with Form A. f

of the last preceding regulation relates.

Inspector 7. The driver of a vehicle upon which firewood is being carried
may require

be weighted. (a) drive the vehicle to the nearest weighbridge or place where

weighing may be undertaken;

(b) permit the Inspector to weigh the vehicle and the firewood

thereon; and

(c) render prompt and efficient assistance in the weighing of

the vehicle and of the firewood and in any unloading or loading which is necessary for the purposes of the weighing.

Penalty: Five pounds.
Penalty for 8.— (1.) Where the weight of any firewood carried for delivery

incorrect

in respect of that firewood,

the vendor of the firewood shall be guilty of an offence.

Penalty: Ten pounds.
(2.) I t shall be a defence in any prosecution under this section

if it is proved that the vendor of the firewood dispatched the vehicle loaded with the correct weight, according to the label or docket, of the firewood, and, in that event, the driver of the vehicle shall be guilty of an offence.

Penalty: Ten pounds.

9.—(1.) A vendor who fails to issue to the driver of a vehicle Failure to

Penalty: Ten pounds.

(2.) A driver who fails to carry or to deliver as prescribed to the

purchaser of any firewood the docket issued to him by the vendor

in respect thereof shall be guilty of an offence.

Penalty: Ten pounds.

10. The requirements of these Regulations shall not apply in the E xemption of

case of firewood delivered in bulk from a railway truck direct to the deliveries by

rail. &0-

(a) the whole of the firewood in the truck is for delivery to

one purchaser only and he has.agreed to accept delivery

on tbe basis of the railway freight weights thereof; or

(b) the vendor has agreed with the purchaser to determine the weight of the firewood on a weighing instrument provided by the purchaser.

11. The requirements of these Regulations respecting the sale and Purchases by delivery of firewood by weight shall not apply to sales and deliveries than weight" thereof in quantities exceeding five hundredweights where tbe purchaser

by agreement with the vendor in writing prior to the delivery of the

firewood arranges for the purchase otherwise than by weight.
