Salaries
and Wages Pause (Exemptions) Regulations

of the Federal Executive Council, hereby make the following Regulations under
the Salaries and Wages Pause Act 1982.

Citation
1. These Regulations may be
cited as the Salaries and Wages Pause (Exemptions) Regulations.
Interpretation
2. In these Regulations, “the
Act” means the Salaries and Wages Pause
Act 1982.
Exemptions
in relation to certain increases, during the prescribed period, of the rates of
remuneration of certain Commonwealth employees
3. A tribunal or authority
specified in column 2 of an item in Schedule 1, being a tribunal or authority
referred to in section 8 of the Act, shall have, during the prescribed period,
the powers that would, but for that section, be exercisable by that tribunal or
authority in relation to the making or varying of an award or determination, or
the making, varying or certifying of an industrial
agreement,
specified in column 3 of that item so as to increase the rates, or minimum
rates, of the remuneration payable to a Commonwealth employee engaged in
employment of the kind specified in column 4 of that item and who is employed
by the organization specified in column 5 of that item, being an increase that
is treated as flowing on from the award or determination specified in column 6
of that item.
Exemptions
in relation to certain increases, during the prescribed period, of allowances
of certain Commonwealth employees
4. (1) A tribunal or authority
specified in column 2 of an item in Schedule 2, being a tribunal or authority
referred to in section 8 of the Act, shall have, during the prescribed period,
the powers that would, but for that section, be exercisable by that tribunal or
authority in relation to the making or varying of an award or determination, or
the making, varying or certifying of an industrial agreement, specified in
column 3 of that item so as to increase the rates, or minimum rates, of the
allowance specified in column 4 of that item payable to a Commonwealth employee
who is employed by the organization specified in column 5 of that item, being
an increase that is treated as flowing on from the award, decision or
determination specified in column 6 of that item.
(2) The Australian
Telecommunications Commission, being an authority referred to in section 8 of
the Act, shall have, during the prescribed period, the powers that would, but
for that section, be exercisable by it in relation to the making of a
determination under sub-section 43 (1) of the Telecommunications Act 1975 so as to increase the rates, or minimum
rates, of site allowance, or to establish a new site allowance, payable to
officers or employees of that Commission who, in the course of their employment
with that Commission, undertake work on building and construction sites, being
an increase of site allowance, or the establishment of a new site allowance,
that is treated as flowing on from an increase, or a new allowance, that has
been approved by the Australian Conciliation and Arbitration Commission or a
State industrial authority.
Exemptions
in respect of certain claims, during the prescribed period, in relation to
terms and conditions of certain Commonwealth employees
5. A tribunal or authority
specified in column 2 of an item in Schedule 3, being a tribunal or authority
referred to in section 8 of the Act, shall have, during the prescribed period,
the powers that would, but for that section, be exercisable by that tribunal or
authority in relation to the making or varying of an award or determination
specified in column 3 of that item for the purposes of the claim specified in
that column of that item, being a claim by Commonwealth employees engaged in
employment of the kind specified in column 4 of that item and who are employed
by the organization specified in column 5 of that item.
