An Act to amend the Saint Vincent’s Hospital Act, 1912, and to transfer certain land held by the trustees of the land on which Saint Vincent’s Hospital is erected to the Trustees of the Sisters of Charity of Australia, and for other purposes. [Assented to, 15th May, 1985.]

Saint Vincent’s Hospital (Amendment) 1985

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1.     This Act may be cited as the “Saint Vincent’s Hospital (Amendment)

Act. 1985'’.	'
Commencement.

2. (1) Sections 1 and 2 shall commence on the date of assent to this Act. (2) Except as provided by subsection (1), this Act shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

Amendment of Act No. 5. 1912.

3. The Saint Vincent’s Hospital Act, 1912. is amended in the manner

set forth in Schedule I.

Transfer of certain land.

4.         (1) The land comprised in the certificate of title issued under the Real

Property Act, 1900, as Volume 8293 Polio 193 is hereby—

(a)	divested from the trustees for the time being of the land on which Saint Vincent’s Hospital is erected; and
(b)	vested in the Trustccs of the Sisters of Charity of Australia for an estate m fee simple and. notwithstanding any other Act, on trust for the purposes of the Congregation of the Religious Sisters of Charity of Australia but freed and discharged from any trusts, whether statutory or otherwise, which affected that land immediately before its being so vested.

(2) Subsection ( I ) docs not operate so as—

(a) to affect any reservation or condition contained in the Crown grant referred to m the certificate of title to which that subsection relates; or

(b) to vary or to discharge or extinguish any mortgage, charge, lease or easement, within the meaning of the Real Property Act, 1900, w'hich. immediately before the commencement of this Act, affected the land comprised in that certificate of title.

SCHEDULE 1.

(Sec. 3.)

Amendments to the Saint Vinc ent’s Hospital Act, 1912.

( 1 ) Section 1a —

After section 1, insert:—

Application of Act.

1a. This .Act does not apply to or in respect of the land comprised in the certificate of title issued under the Real Property Act, 1900, as Volume 8293 Folio 193.

(2) Section 2—

Omit "the religious order of the Sisters of Charity in New South Wales” , insert instead "the Congregation of the Religious Sisters of Charity of Australia” .

(3) (a) Section 3(1)-

Omit "is now built” , insert instead	‘was built at the
commencement of this Act”.

(b) Section 3 ( I)—

Omit “and residence'

(c) Section 3 (2)—

Omit the subsection.
