" and Ireland in New South Wales " subject to t h e t rus ts condit ions reservations and provisoes thereinafter conta ined all t h a t piece or parcel of land conta in ing by admeasurement thir ty-four perches be t he same more or less s i tuated in t he coun ty of Cumber land par ish of Saint A n d r e w city of Sydney par t of a l lo tment five of section n ine com- menc ing a t t h e south-western corner of a l lo tment four and bounded thence on t h e south by pa r t of t h e no r the rn boundary- l ine of a l lo tment th ree bear ing south e ighty degrees west thirty-five l inks and thence by pa r t of t he n o r t h e r n boundary- l ine of a l lo tment six bear ing south e ighty- two degrees fifteen minu tes west n inety- two l inks on t he west by a l ine dividing i t from an a l lo tment of one rood and eight perches pa r t of a l lo tment five bear ing n o r t h fifteen minu tes west one chain and sixty-five l inks to Liverpool-street on t h e nor th by t h e southern bui lding-l ine of t h a t s t reet bear ing easterly one cha in and forty-two l inks and on the east by the wes tern boundary- l ine of a l lo tment four aforesaid bear ing south five degrees th i r ty minu tes west one cha in and fifty-two l inks to t he point of commencemen t wi th all t h e r igh t s and appur tenances whatsoever there to belonging upon t ru s t for t he appro- pr ia t ion thereof as a site of a dwell ing-house garden a n d o ther appur - tenances for the Clergyman duly appointed to officiate in t h e Church of t h e U n i t e d Church of E n g l a n d and I r e l and erected a t Sydney and known as Saint Andrew in conformity with t he provisions of t h e said A c t and of a cer tain o ther A c t of t h e Governor and Legislat ive Council made and passed in t he seventh year of t h e re ign of his said la te

1. The said Bishop of Sydney or his successors Bishops of Sydney m a y sell and dispose of the said parcel of land hereinbefore described by publ ic auct ion or pr ivate contract e i ther in one lot or in several lots as the said Bishop of Sydney or his successors Bishops of Sydney shall t h i n k

" building of Churches and Chapels and to provide for the maintenance " of Ministers of Religion in New South Wales" so far as t he same m a y apply to t he t rus t s of t he said gran t and for no other purpose whatsoever A n d whereas t he said Church of Saint Andrew is now the Cathedra l Church of Saint Andrew A n d whereas t he said parcel of land is inconvenient ly s i tuated and t h e bui ld ing erected thereon unsui table for t h e residence of t h e chief officiating Minis te r of t he said Cathedral Church And i t is deemed expedient to sell t h e said land and to apply t he proceeds ar is ing from such sale in or towards t he erection of a sui table residence for t h e chief officiating Minis te r of the said Cathedra l Church of Saint Andrew wi th in t he said Cathedra l Close Be it therefore enacted by the Queen ' s Mos t Exce l l en t Majesty by and wi th t he advice and consent of the Legislat ive Council and Legislat ive Assembly of New South Wales in Pa r l i amen t assembled and by t h e

t h i n k most expedient for such price as can be reasonably had or obtained for the same and m a y convey t h e same or any par t thereof w h e n sold to the purchaser and thereupon t h e same shall vest absolutely in t he said purchaser his heirs and assigns freed and discharged from t h e said t rusts affecting t he same and the receipt in wri t ing of t he said Bishop of Sydney or his successors Bishops of Sydney shall absolutely discharge the purchaser of t he said land or any par t thereof from the purchase money payable by h i m and shall exonerate h i m from seeing to t h e applicat ion of t h e said purchase money and from all l iabili ty as to the misapplicat ion or non-applicat ion thereof.

2. The said Bishop of Sydney and his successors Bishops of Sydney shall s tand possessed of all moneys arising from such sale as aforesaid upon t rus t to apply t he same in or towards t he erection upon a port ion of t h e l and granted for t h e use of t he said Cathedral or par t ly upon t h e said land and par t ly upon the land described in t he Schedule to t he A c t thir ty-four Victoria n u m b e r six of a sui table residence wi th t h e appur tenances the reun to belonging as a residence for t h e Clergyman duly appointed to officiate in t h e said Cathedral Church of Saint Andrew in t he said City of Sydney and the receipt in wr i t ing of any person to whom any moneys shall be paid unde r t h e provisions of th is A c t shall be a valid and complete discharge to t he said Bishop of Sydney or his successors Bishops of Sydney for such moneys .

The person for t he t ime-being duly licensed and appointed by the Bishop of Sydney to be t he Officiating Minis ter of t he said Cathedral Church of Saint Andrew shall be ent i t led to freely use have possess and enjoy the said residence so to be erected as aforesaid wi th the appur tenances wi thou t any h indrance or in te r rupt ion from or by any person whomsoever b u t subject to t h e provisions of t he A c t of the Legis la ture of New South Wales first hereinbefore recited.
