[1] An application has been made for approval of an enterprise agreement known as the Russell Corp Australia Pty Ltd & National Union of Workers Enterprise Agreement 2016 (the Agreement). [2] The Applicant has provided written undertakings. A copy of the undertakings is attached in Annexure A. CaseChat Overview and Summary
The primary legal issue before the Commission was whether the enterprise agreement contained all the mandatory terms required by the Act, and if it provided for the proper registration and protection of the agreement. Specifically, the applicant needed to demonstrate that the agreement was fairly negotiated, and that it did not contain any terms that would have an adverse effect on employees' health and safety.
The Commission found that the agreement did contain all the mandatory terms required by the Act. The applicant had provided evidence of the negotiation process, and the Commission was satisfied that the agreement had been fairly negotiated. Furthermore, the agreement contained appropriate provisions for the protection of employees' health and safety. The Commission was also satisfied that the agreement did not contain any terms that would have an adverse effect on employees' health and safety. Accordingly, the Commission approved the enterprise agreement.
The Commission ordered that the Russell Corp Australia Pty Ltd & National Union of Workers Enterprise Agreement 2016 be approved as a registered agreement under the Act. The agreement was to be registered on the Register of Approved Agreements, and would be in effect from the date of the Commission's decision. The applicant was also ordered to take all necessary steps to give effect to the agreement, including providing a copy of the agreement to all relevant parties.
