RURAL RELIEF FUND.

No. 39 of 1942.
AN ACT to amend section eleven of the Rural
Relief Fund Act, 1935.
[Assented to 23rd December, 1942.]
BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legisla- tive Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
1. This Act may be cited as the Rural Relief Fund Short title.
Act Amendment Act, 1942, and shall be read as one with
the Rural Relief Fund Act, 1935 (No. 17 of 1935), here-
inafter referred to as the principal Act.
| 2. | Section eleven of the principal Act is amended by Amendment | of a. 1/ of |
addino. thereto a new subsection as follows :—

(3) Where the Trustees are satisfied
| (a) | that a farmer has enlisted as a member of the |
Forces; or
| (b) | that the property over which an advance under this Act has been secured by a mortgage or charge is situate within a marginal area; or |

| (c) | that a farmer's debts have been adjusted under the provisions of the Farmers' Debts Adjust- ment Act, 1930-1934, or this Act, and since such adjustment the principal secured creditor has voluntarily written down or adjusted his debt in favour of the farmer; or |
| (d) | that a farmer has abandoned his property and the mortgagee is obliged to sell the property for a sum less than the full amount of prin- cipal and interest then due under the mortgage; or |
| (e) | that the farmer is for any other good reason |
deserving of assistance
the Trustees may, subject to the consent of the Minister for Lands and with the approval of the Governor, write off the whole or such portion of the aggregate indebted- ness of the farmer as the Trustees consider just and equitable in the circumstances.
The provisions of this section shall apply to the estate
of a deceased farmer.
