RURAL LANDS PROTECTION ACT 1989—REGULATION

(Relating to the election of directors of rural lands protection boards and the

display of combined stock warning signs)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Rural Lands Protection Act 1989, has been pleased to make the Regulation set forth hereunder.

The Rural Lands Protection Regulation 1990 is amended:

(a) by omitting from clause 11 (d) the word “cross” and by inserting instead the word “tick”;
(b) by omitting from clause 16 (c) the word “crosses” and by inserting instead the word “ticks”;
(c) by omitting from clauses 83 (5) (b) and (7) (b) and 89 (2) (b) the matter “A or B” wherever occurring and by inserting instead the matter “A, B or C”;
(d) by omitting from clause 83 (7) the matter “subclause (6) (c)” and by inserting instead the matter “subclause (6) (c) (i)”;
(e) by omitting clause 83 (9) and by inserting instead the following
subclauses :

(9) A stock warning sign that contains the particulars shown in Diagram A or B in Part 2 or 3 of Schedule 3 may be made of reflective material if it is displayed at night.

(10) A stock warning sign that contains the particulars shown in Diagram C in Part 2 or 3 of Schedule 3 must be made of reflective material if it is displayed at night.

EXPLANATORY NOTE

The object of this Regulation is to amend the Rural Lands Protection Regulation

1990 so as:

(a)

to correct an inconsistency relating to the manner in which ballot-papers used in the election of directors of rural lands protection boards are to be completed by requiring electors to place a tick (rather than a cross) before the name of each candidate for whom the elector wishes to vote (paragraphs (a) and (b)); and

(b)

to provide for the use of combined stock warning signs (i.e. signs that depict both large and small stock) as currently the Rural Lands Protection Regulation 1990 permits only the use of stock warning signs that depict either large stock or small stock (paragraphs (c)–(g)).

The Regulation is made under sections 16, 96 and 217 (2) (j) of the Rural Lands

Protection Act 1989.
