Explanatory note
The object of this Regulation is to update a provision authorising the giving of a penalty notice for the offence of failing to comply with a total fire ban order under section 99 of the Rural Fires Act 1997. This is as a consequence of the substitution of that offence by the Emergency Services Legislation Amendment Act
2018.
This Regulation is made under the Rural Fires Act 1997, including sections 131 and 135 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Rural Fires Amendment (Penalty Notices) Regulation 2018.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

Schedule 2 Penalty notice offences
Omit “Section 99 (6)”. Insert instead “Section 99 (11)”.
