Rural Fires Act Amendment Act 1973
540 ANNO VICESIMO SECUNDO EEIZA E AE SECUN D AE R E G I N AE No0 61 of 1973 An Act to am end the Rural Fires Act 1946-1970 in certain particul ars [ASSENTED TO 22ND NOVEMBER, 1973] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Rural Fires Act Amendment Act 1973. (2) The Rural Fires Act 1946-1970 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Rural Fires Act 1946-1973. 2. Repeal of and new s. 42. Section 42 of the Principal Act is repealed and the following section is substituted:- " 42. Establishment of trust fund for administration of Act. (1) There shall be established and maintained in the Treasury a fund under the name " Rural Fires Board Trust Fund ", which fund is in this section and in sections 42B and 42c referred to as the Fund.
Rural Fires Act Amendment Act 1973, No. 61 541 (2) There shall be paid into the Fund in each year- (a) all moneys appropriated by Parliament in respect of that year for the purposes of this Act; (b) all moneys received by the Treasury on account of the additional contribution required by section 42A to be paid by contributory companies and owners of property under the Fire Brigades Act 1964-1971; (c) all other moneys received by the Board in the course of the administration of this Act.". 3. New ss. 42A, 42B, 42C and 42D . The Principal Act is amended by inserting after section 42 the following sections;- " 42A. Contribution by contributory companies and owners of property . (1) In addition to the total annual contribution required to be paid by them under the Fire Brigades Act 1964-1971, contributory companies and owners of property shall, in respect of the year commencing on the first day of July 1973 and in respect of each subsequent year, pay under that Act as part of the total annual contribution in respect of each year the amount of $50 000 or, where the Governor in Council prescribes another amount as the contribution required by this section to be paid by contributory companies and owners of property, that other amount. The Governor in Council may, by regulation, prescribe another amount referred to in this subsection either generally or in respect of a particular year. (2) The contribution required by this section to be paid shall, for the purpose of its collection from contributory companies and owners of property, be included in the total annual contribution for each year, and shall be collected by way of the precepts issued pursuant to the Fire Brigades Act 1964-1971 and in accordance with that Act, and the provisions of that Act that apply in respect of the collection of contribution to the total annual contribution by contributory companies and owners of property shall apply in like manner in respect of the collection of contribution required by this section to be paid. 42n. Appropriation of contribution to Fund. (1) Moneys paid on account of contribution required by section 42A to be paid shall be deposited in the first instance to The Fire Brigades Precepts Trust Fund as part of the total annual contribution. (2) The Treasurer-- (a) shall, in each year, cause the moneys received by the Treasury on account of contribution required by section 42A to be paid and deposited to The Fire Brigades Precepts Trust Fund to be transferred into the Fund; and (b) shall cause moneys comprising the Fund to be made available for use of the Board for the purposes of this Act as certified to him by the permanent head of the department administered by the Minister. 42C. Expenditure from Fund. All costs and expenses incurred in the administration of this Act shall be met from moneys standing to the credit of the Fund.
542 Rural Fires Act Amendment Act 1973, No. 61 42D. Interpretation . In sections 42 to 42B and in this section- contributory companies " means the insurance companies that are liable under the Fire Brigades Act 1964-1971 to contribute to the total annual contribution; " owners of property " means .the owners of property referred to in section 39 of the Fire Brigades Act 1964-1971 who are liable under that Act to contribute to the total annual contribution; " total annual contribution " means the aggregate of the moneys to be contributed under the Fire Brigades Act 1964-1971 by contributory companies and owners of property in respect of the year in question; " year " means the period of time from and including the first day of July in one calendar year to and including the thirtieth day of June in the next following calendar year.". 4. Retrospectivity. The Principal Act shall have effect and be deemed for all purposes to have had effect as if sections 42, 42A, 42B, 42c and 42D as inserted by this Act were included therein on and from the first day of July 1973, and those sections shall have retrospective operation accordingly.
