Rules of the Supreme Court of the

Australian Capital Territory2 (Amendment)

WE, Judges appointed under sub-section 7 (1) of the Australian Capital Territory Supreme Court Act 1933, hereby make the following Rules of Court under section 28 of that Act.

Commencement

1. These Rules shall come into operation on 1 December 1986.

Principal Rules

2. In these Rules, “Principal Rules” means the Rules of the Supreme Court of the Australian Capital Territory.

Indorsement of notice as to stay of proceedings

3. (1) Rule 6 of Order 4 of the Principal Rules is amended—

(a) by omitting from paragraph (3) (a) “$263” and substituting “$268”;

and

(b) by omitting from sub-rule (4) “$307” (wherever occurring) and substituting “$312”.

(2) The amendments effected by sub-rule (1) apply to writs issued on or after 1 December 1986.

 

Scale of costs

4. Rule 7 of Order 65 is amended—

(a) by omitting from sub-rule (4) “on or after 1 March 1986” and substituting “during the period that commenced on 1 March 1986 and ended at the expiration of 30 November 1986”; and

(b) by adding at the end the following sub-rule:

“(5) The amount that may be claimed under the Fourth Schedule (except under item 36 or 37) in respect of work done or services performed on or after 1 December 1986 is increased by 11.35%.”.
