Rules of the Supreme Court of the

Australian Capital Territory (Amendment)

WE, Judges appointed under subsection 7 (1) of the Australian Capital Territory Supreme Court Act 1933, hereby make the following Rules of Court under section 28 of that Act.

Commencement

1. These Rules shall come into operation on 1 October 1987.

Principal Rules

2. In these Rules, “Principal Rules” means the Rules of the Supreme Court of the Australian Capital Territory.

Indorsement of notice as to stay of proceedings

3. (1) Rule 6 of Order 4 of the Principal Rules is amended:

(a) by omitting from paragraph (3) (a) “$337” and substituting “$340”;

and

(b) by omitting from subrule (4) “$382” (wherever occurring) and substituting “$387”.

(2) The amendments effected by subrule (1) apply to writs issued on or after 1 October 1987.

 

Scale of costs

4. Rule 7 of Order 65 of the Principal Rules is amended:

(a) by omitting from subrule (6) “on or after 1 June 1987” and substituting “during the period that commenced on 1 June 1987 and ended at the expiration of 30 September 1987”; and

(b) by adding at the end the following subrule:

“(7) The amount that may be claimed under the Fourth Schedule (except under item 36 or 37) in respect of work done or services performed on or after 1 October 1987 is increased by 16.87%.”.
