Australian Capital Territory2 (Amendment)

WE, Judges appointed under subsection 7 (1) of the Australian Capital Territory Supreme Court Act 1933,hereby make the following Rules of Court under section 28 of that Act.

Principal Rules

1. In these Rules, “Principal Rules” means the Rules of the Supreme Court of the Australian Capital Territory.

Indorsement of notice as to stay of proceedings

2. (1) Rule 6 of Order 4 of the Principal Rules is amended:

(a) by omitting from paragraph (3) (a) “$345” and substituting “$408”;

(b) by omitting from subrule (4) “$394” (wherever occurring) and substituting “$458”.

(2) The amendments made by subrule (1) apply in relation to writs issued on or after 1 September 1988.

Scale of costs

3. Rule 7 of Order 65 is amended by adding at the end the following subrule:

“(4) In respect of work done and services performed by a solicitor on or after 1 September 1988, a reference in this rule to the costs set out in, or the charges provided for by, the Fourth Schedule (other than items 36 and 37 of the Schedule), is a reference to those costs or charges increased by 1.6%.”.
