Rules of the Supreme Court of the Australian Capital Territory2 (Amendment)

WE, Judges appointed under subsection 7 (1) of the Australian Capital Territory Supreme Court Act 1933, make the following Rules of Court under section 28 of that Act.

1. Commencement

1.1 These Rules commence on 1 January 1992.

2.Amendment

2.1 The Rules of the Supreme Court of the Australian Capital Territory are amended as set out in these Rules.

 

3. Order 42a, rate 1 (Rate of interest)

3.1 Omit “20% per annum”, substitute “15% a year”.

4. Order 42a, role 2 (Rate of interest in respect of earlier judgments)

4.1 Omit the rule, substitute:

Rates of interest for earlier judgments

“2. In respect of a judgment entered before 1 January 1992:

(a) the rate of interest fixed for the period beginning on the day on which judgment was entered and ending at the end of 30 April 1986 is:

(i) for a judgment entered before 1 October 1977—5% a year; and

(ii) for a judgment entered on or after 1 October 1977— 10% a year; and

(b) the rate of interest fixed for the period:

(i) beginning on 1 May 1986 and ending at the end of 30 June 1990 is 15% a year; and

(ii) beginning on 1 July 1990 and ending at the end of 31 December 1991 is 20% a year.”.
