RULES OF THE SUPREME COURT OF THE AUSTRALIAN CAPITAL TERRITORY.*

 

PURSUANT to the Australian Capital Territory Supreme Court Act 1933-1971 and the Matrimonial Causes Act 1959-1966, IT IS ORDERED that the Rules of the Supreme Court of the Australian Capital Territory be amended, as follows:—

Attendance by solicitors or clerk in Court or in Chambers to instruct counsel.

1. Order 65 is amended by inserting after Rule 35 the following rule:—

“ 35a. (1) Where a principal solicitor attended in Court or in Chambers or before the Registrar to instruct counsel, the taxing officer may allow the amount shown in the Fourth Schedule for such an attendance if he is of opinion that, by reason of the importance or difficulty of the matter or because of the responsibility involved in instructing counsel, the attendance of the principal solicitor was warranted, but if he is not of that opinion, the taxing officer may allow whichever of the amounts shown in the Fourth Schedule for such an attendance by either an employed solicitor or clerk as he considers the circumstances warranted.

“ (2) Where an employed solicitor attended in Court or in Chambers or before the Registrar to instruct counsel, the taxing officer may allow the amount shown in the Fourth Schedule for such an attendance if he is of opinion that theattendance was warranted, but if he is not of that opinion he may allow the amount shown in the Fourth Schedule for the attendance of a clerk.

“ (3) No allowance shall be made for the attendance of a clerk in Court or in Chambers or before the Registrar to instruct counsel unless he was competent to instruct counsel in the particular matter.”.

2. The Fourth Schedule is repealed and the following Schedule substituted:—

Definition

106. In this Schedule, “ Matrimonial Causes ” means a proceeding under the Matrimonial Causes Act 1959-1966.

Application of Amendments.

3. The Schedule inserted by Rule 2 applies to all work done or services performed on or after 31st May, 1973, and, notwithstanding its repeal, the Schedule repealed by that rule continues to apply to all work done or services performed before that date.
