MR D.C. RANGIAH: I appear for the applicant. (instructed by Drakopoulos Black)
MR S.J. GAGELER, SC: I appear with MR S.J. LEE for the respondent. (instructed by Blake Dawson Waldron)
HIS HONOUR: Mr Rangiah, you want to have the matter adjourned; is that right?
MR RANGIAH: Your Honour, I do not make an application for it to be adjourned. I just point out that as a matter of convenience for the Court it may be appropriate to adjourn the matter, given that there is to be a hearing in the Federal Court on Monday.
HIS HONOUR: Well, that would seem to be sensible, Mr Gageler, would it not?
MR GAGELER: It seems to be an eminently sensible course, your Honour, and one in which we would acquiesce. The application before your Honour raises a very short point and my submissions would be about three lines. It is really a matter of your Honour’s convenience whether your Honour deals withit - - -
HIS HONOUR: Well, I think it is better that the matter go to the Federal Court.
MR GAGELER: Yes.
HIS HONOUR: I will simply adjourn your application, Mr Rangiah; is that right?
MR RANGIAH: Yes, thank you.
HIS HONOUR: I will adjourn it to a date to be fixed and, what, reserve costs or what ‑ ‑ ‑
MR RANGIAH: Yes, thank you, your Honour.
HIS HONOUR: And I reserve the cost. Thank you. You are excused, Mr Rangiah.
MR GAGELER: Does your Honour need to certify for counsel?
HIS HONOUR: Well, I will certify for counsel with respect to this appearance, yes.
