The Tribunal was required to determine the weight to be given to "other considerations" under Ministerial Direction 90, particularly in light of previous judicial pronouncements that such considerations, irrespective of their designation, could in appropriate circumstances outweigh primary considerations. Furthermore, the Tribunal had to actively consider and weigh any claims raised regarding Australia's non-refoulement obligations, rather than deferring such considerations to a potential Protection Visa application.

In its reasoning, the Tribunal acknowledged that while Ministerial Direction 90 outlines primary and other considerations, the weight accorded to each is not fixed. Drawing on authority, the Tribunal held that "other considerations" could, depending on their character and the specific circumstances of the case, be given significant weight, potentially even overbearing the primary considerations. The Tribunal also emphasised the obligation to give active intellectual consideration to non-refoulement claims when raised, and to weigh these claims appropriately, as mandated by Full Federal Court decisions. The Tribunal ultimately set aside the Minister's decision and substituted it with a decision to revoke the cancellation of RRKW's visa.
