AN ACT relating to the Observance of a Special Holiday in honour of the occasion of the Royal Visit in the year one thousand nine hundred and fifty-two.

BE it enacted by the King's Most Excellent
Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

provision. following expressions, where used in this Act, have
the respective meanings set out in this section
"recognised holiday" means a day appointed
as
a public holiday by the Bank Holidays Act, 1884-1948, or by or pursuant to any other Act or regulation, including the Industrial Arbitration Act, 1912-1950, and any award or industrial agreement made pursuant to the provisions of that Act;
a Public Service holiday by the Public
Service Act, 1904-1950;
"special holiday" means the public holiday

provisions of this Act, be observed on such day as the Governor by Proclamation appoints for the purpose.
4. The Governor may appoint a specified day for Appointment

such of the various parts of the State as he thinks

special holiday in each of those parts as in his
opinion will best enable the persons in that part to
observe the occasion.

| (a) | from time to time cancel the appointment of the day and appoint another day to be observed as the special holiday; or |
| (b) | cancel the appointment of the day abso- lutely; |
in order that any change of plans for the Royal Visit may be appropriately met and such subsequent Proclamation shall have effect accordingly.
6. (a) If the special holiday is observed on a day Provisions
which is a recognised holiday, a person who is holidayand
entitled to the recognised holiday shall, subject to holidaylap

entitled to such other day as the Governor declares by Proclamation as a holiday in place of the recog- nised holiday.
(b) Where for the purpose of the last preceding paragraph, the Governor declares a day as a holiday in place of a recognised holiday, he may from time to time by subsequent Proclamation cancel the

declaration and declare another day as a holiday in place of the recognised holiday, and such subse- quent Proclamation shall have effect accordingly.
Special
In the event of the special holiday being observed in the metropolitan area on the third day of March, one thousand nine hundred and fifty-two, on which day the public holiday and Public Service holiday of Labour Day would otherwise be observed, Labour Day shall by virtue of the provisions of this section be observed throughout the State on the twenty-fourth day of March of that year, notwith- standing the provisions of the Bank Holidays Act, 1884-1948, or those of the Public Service Act, 1904- 1950.

Effect of
(1) Any Act or regulation, or any award or pursuant to the provisions of the Industrial Arbitra- tion Act, 1912-1950, whether or not such Act, regulation, award, or industrial agreement provides for certain specified days or for a certain number of days to be observed or treated as public holidays, or empowers the Governor by Proclamation or otherwise to proclaim, appoint or declare any day as a public holiday, shall be deemed to be amended so as to provide that the special holiday shall be observed or treated as a public holiday without deduction of pay.

| (2) Any person required by his employer to work on the special holiday shall |
| (a) | be compensated for such work in accord- ance with the provisions of such Act, regulation, award, or industrial agreement for work on public holidays; or |
| (b) | in the absence of any such provision, be paid for such work at the rate of double time, or, at the option of the employer, have one day added to his annual leave, or if he works for part only of the special holiday, shall have an equivalent number of hours added to his annual leave. |
