QUEENS. LAND ACT OF 1931. [ASSENTED TO 14TH JANUARY, 1932.J Preamble. '''THEREAS in pursuance of *" The Acclimatisation Vl Society Act of 1907" the trustees denoted in section two of the said Act sold to the Council of the City of Brisbane the land described in the Schedule to the' said Act, and the said Council became and was registered by Certificate of Title Number 215621, Volume 1261, Folio 111, as the proprietor in fee-simple of the said land and under the said Act held the same as a reserve for public park purposes: And whereas by section thirty of t" The Oity of Brisbane Act of 1924" it was enacted, inter alia, that by virtue of that Act, on and after the first day of October, one thousand nine hundred and twenty-five, all the property, whether real or personal, of the local bodies existing at that date (of which the said Council of the City of Brisbane was one) should, without any transfer~ assignment, or conveyance or notice other than that Act, be divested from the said local bodies and each of them, and should be vested in and should attach to the Council (being the Brisbane City Council as defined by t" The City of Brl:sbane Act of 1924") : And whereas under and in pursuance of t".The RoyalNationalAgriculturalandIndustrialAssociationof Queensland Act of 1929" the Brisbane City Council sold and conveyed to the Royal National Agricultural and Industrial Association of Queensland part of the said land (therein called the "creek land ") and remains and is registered by the said Certificate of Title as the proprietor in fee-simple of the remainder of the said land as a reserve for public park purposes: And whereas the Royal National Agricultural and Industrial Association of Queensland is desirous of * 7 Edw. Royal iYational Agricultural, Etc., Act. further extending the scope of its operations and, for that purpose, of purchasing the portions of the said land . described in the First Schedule to this Act : ~ ~ ~ s: dule. And whereas it is expedient that the said Brisbane City Council should be empowered to deal with the said portions by sale thereof to the said Association and should be empowered and required to apply the proceeds of such sale in or towards the improvement of any public park or reserve for public park purposes under the control of the said Council- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Royal National Short title. Agric'ltltural and Industrial Association of Queensland Act of 1931." 2. The Brisbane City Council (constituted by virtue of Power. to the provisions of *"The City of BrisbaneActs, 1924 to 1930," ~~ nctl to and hereinafter referred to as the" Council") is hereby empowered to sell to the Royal National Agricultural and Industrial Association of Queensland (hereinafter referred to as the "Association") the lands described in the First Schedule to this Act, by private contract and ~ i~ Btd I for cash or on credit or partly for cash and partly on' c e u e. credit, and subject to and upon such restrictions, covenants, and conditions as may be agreed upon by any contract for sale made by and between the Council and the Association, and shall have full power immediately on the receipt of the purchase money and the performance of all such covenants and conditions to convey the same to the Association, to be held by the Association for its objects and purposes and for the purposes of carrying on the operations thereof and for no other purpose whatsoever. 3. The Council shall apply the proceeds of such Proceeds of sale in and towards the making of improvements in or sale. upon any public park or reserve for public park purposes under its control, or for the purchase or acquisition of land for public park purposes. 4. No. 52, 1931. or shall ceaseto occupy the lands adjoining the same on the south-east buundary thereof for the said objects and purposes, the Association shall re-transfer and convey the said lands to the Council, to be held by it as a reserve for public park purposes. Exoneration of 5. The Association shall not be bound to see to the Association application and shall not be liable for the mis-application or non-application of any purchase money paid by them in pursuance of this Act. Second Schedule. 6. A plan of the land (described in the First Schedule) is set forth in the Second Schedule of this Act. No further approval to 7. FIRST SCHEDULE. All that piece or parcel of land described as Resubdivision 4 of Subdivision I of Portion 331, County of Stanley, Parish of North Brisbane, City of Brisbane, containing one acre two roods eighteen and four-tenths perches, more or less, commencing at the south corner of Resubdivision 3 and bounded thence on the north-west by that Resubdivision bearing 45 0 35' eight .chains sixty-seven and sixty-one one-hundredths links, on the east and the south-east by Resubdivision 2 bearing 184 0 21' ninety-two and sixty-five one- hundredths links, 187 0 10' eighty links, 190 0 57' eighty links, 196 0 5' seventy-nine and ninety-three one-hundredths links, 223 0 23' ·30" one chain thirty-eight and seven-tenths links and 227 0 27' 20" six chains thirty-seven and two-tenths links, and on the west by Bowen Bridge Road bearing 359 0 52' 15" two chains fifty-one and fifty-two one-hundredths links to the point of commencement; and being part of the land contained in Certificate of Title Number 215621, Volume 1261, Folio Ill. Also all that piece or parcel of land described a'3 Resubdivision I of Subdivision I of Portion 331, County of Stanley, Parish of North Brisbane, City of Brisbane, containing two roods four and six-tenths perches, more or less, commencing at the north-west corner of portion 345, and bounded thence on the south-east by that portion bearing 204 0 Il' four chains and eighty-four and two-tenths links, on the west by Resubdivision 3 bearing 354 0 36' four chains and forty-two and thirty-six one-hundredths links, and on the north by O'ConneU Terrace bearing 89 0 41' two chains and forty links to the point of commencement; and being part of the land contained in Certificate of Title Number 215621, Volume 1261, Folio Ill.
