W HEREAS in pursuance of *"The Acclimatisation PreH.mble. Society Act of 1907" the trustees denoted in section two of the said Act sold to The Council of the City of Brisbane the land described in the Schedule to the said Act, and the said Council became ':1nd is registered by Certificate of Title number 215621, Volume 1261, Folio 111, as the proprietor in fee simple of the said land and under the said Act holds the same as a reserve for public park purposes: And whereas by section thirty of t"The Oity of Brisbane Act of 1924" it was enacted, inter alia, that by virtTle of that Act, on and after the first day of October, one thousand nine hundred and twenty-five, all the property, whether real or personal, of the local bodies existing at that date (of which the said Council of the City of Brisbane was one) should, without any transfer, assignment, or conveyance or notice other than that Act, be divested from the said local bodies and each of them, and should be vested in and should attach to the Council (being the Brisbane City Council as defined by t" The City of Brisbane Act of 1924") : And whereas the Royal National Agricultural and Industrial Association of Queensland is desirous of extending the scope of its operations and, for that purpose, of purchasing the portion of the said land described in the ] ~ irst Schedule to this Act (and herein- [Schedule 1.] after called the" creek land") subject to an easement of the nature and extent stated in the Second Schedule ~ ~ c~ edub to this Act over the portion of the creek land described - 'J in the said Second Schedule: --- . - - - - - ~ - - - - . - - - - - - - - - - - - - - * 7 Edw. No. 3:i, And whereas it is expedient that the said Brisbane City Council should be empowered to deal with the creek land by sale thereof to the said Association and should be empowered and required to apply the proceeds of such sale jn or towards the improvement of any public park or rnserve for public park purposes under the control of the said Council: Be it therefore enacted by the rung's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. This Act may be cited as " The Royal National Agricultural and Industrial Association of Queensland Act of HI29." Power to Council to BoIl. [Schedule n.] 2. The Brisbane City Council (constituted by virtue of the provisions of *"The City of Brisbane Act of 1924," and hereinafter referred to as "the Council") is hereby empowered to sell to the Royal National Agricultural and Industrial Association of Queensland (hereinafter referred to as "the Association") the creek land, subject to the easement in favour of the Council described in the Second Schedule to this Act, by private contract and for cash or on credit or partly for cash and partly on credit, and subject to and upon such restrictions, covenants, and conditions as may be agreed upon by any contract for sale made by and between the Council and the Association, and shall have full power immediately on the receipt of the purchase money and the performance of all such covenants and conditions to convey the same to the Association, to be held by the Association for its objects and purposes and for the purposes of carrying on the operations thereof and for no other purpose whatsoever.
