Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Royal Botanic Gardens and Domain Trust Act 1980.

Explanatory note
The object of this Regulation is to prescribe certain offences under the Royal Botanic Gardens and Domain Trust Regulation 2013 as offences that can be dealt with by penalty notice (that is, by an “on-the-spot fine”) and to prescribe the amount payable if they are dealt with in that way. The relevant offences involve the following:

(a) cycling in the Gardens,
(b) failing to obey directions of authorised persons,
(c) failing to leave Trust lands when directed to do so,
(d) obstructing persons who are working on Trust lands.

This Regulation is made under the Royal Botanic Gardens and Domain Trust Act 1980, including sections 22 (the general regulation-making power) and 22B (which provides for the issue of penalty notices for offences against the regulations).

(Penalty Notice Offences) Regulation 2013.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.
