Royal Botanic Gardens (Amendment) Regulations
1996
The Governor in Council, on the recommendation of the
Royal Botanic Gardens Board, makes the following
Regulations:

1. Objective
The objective of these Regulations is to amend the remove certain offences which are now offences under the Royal Botanic Gardens Act 1991 and to reduce the maximum level of penalty prescribed for certain other offences.
2. Authorising provision
These Regulations are made under section 51 of the Royal Botanic Gardens Act 1991.
3. Principal Regulations
In these Regulations the 1Royal Botanic Gardens
Regulations 1994 are called the Principal
Regulations.

4. Substitution of regulation 9
For regulation 9 of the Principal Regulations
substitute—
"9. Protection of flora and fauna(1) A person must not in the Gardens—
(a)
climb upon any tree, plant or other flora; or
(b)
remove any dead timber, log or stump, whether standing or fallen; or
(c)
destroy or interfere with the habitat of any animal.
Penalty: 20 penalty units.
(2) A person must not without reasonable
excuse, interfere with any animal in the
Gardens.
Penalty: 20 penalty units.".
5. Amendment of regulation 10
In regulation 10(1) of the Principal Regulations, paragraph (c) is revoked.
