64.32 PARKS AND PUBLIC LAND. Royal Agricultural Society of Queensland, &c., Act. 5 Go. IT., Power to mortgage. "Trustees" means and includes the said Ernest Thomas Bell, John England, and William Farley, and their duly appointed successors in office for the time being. 3. It shall be laiArful.for the trustees from time to time to raise any sum or sums of money, not exceeding the sum of two thousand pounds, and for that purpose to mortgage the show ground or any part thereof to secure repayment of the moneys so raised with interest thereon: Provided that any moneys so raised shall be applied, firstly, in payment of any existing liabilities incurred in erecting buildings and making improvements in or upon the show ground, and, in the next place, in and towards the erection of other buildings and making further improvements therein or thereon: Provided further that any mortgagee of the show ground shall not be called upon to see to the application of the mortgage moneys. 5 Geo. An Act to Enable the Trustees of a certain Parcel THE ROYAL AGRICUL- TURAL SOCIETY OF QUEENSLAND LAND MORTGAGE ACT OF 1914. of land in the City of Toowoonaba, used for the Purposes of the Royal Agricultural Society of Queensland, to Mortgage the said Land, together with the Buildings erected thereon, and to Devote the Moneys so raised to the erection of a Grand Stand and the Equipment thereof and to other Permanent Improvements on the said Land. Preamble. [ASSENTED TO 23RD OCTOBER, 1914.] W IIEREAS William Ball Slade, Gilbert Gostwyck Cory. and James Taylor are the registered pro- prietors in fee-simple, under " The Real Property Acts, 1861 to 1887,"* of a certain parcel of land situated in the City of Toowoomba, County of Aubigny, Parish of Drayton, containing 19 acres 3 roods 8 perches, more particularly described in deed of grant No. 3188, upon trust for the Royal Agricultural Society of Queensland: And whereas it is necessary in the interests of the said Society and to facilitate the carrying out of its * 25 Vic. No. 14 and amending Acts, ,supra, pages 2984 et seq.

Royal Agricultural Society of Queensland, &c., Act. objects to erect a new grand stand on the said land, and to provide equipment for same and to effect other permanent improvements on the said land: * And whereas it is expedient that the Trustees should be empowered to mortgage the said land, together with the improvements, and to use the moneys arising from such mortgage for the purposes aforesaid: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows 1. This Act may be cited as "The Royal Agricultural Short title. Society of Queensland Land Mortgage Act of 1914." 2. All moneys to arise from any mortgage made in Application pursuance of the powers aforesaid shall be expended in the following order, so far as the same shall extend, that is to say, in payment of— (i.) The reasonable expenses of and attending such mortgage; (ii.) The costs of applying for, obtaining, and passing this Act; (iii.) The cost of erecting a new Grand Stand on the said land; (iv.) The cost of the necessary fittings and equip- ment of the said Grand Stand; (v.) The cost of any other permanent improve- ments on the said land.

The receipts in writing of the Trustees exercising aregcoeoipdts to be any of the powers conferred by this Act for any moneys discharge. paid or advanced to them in respect of any mortgage given in pursuance of the powers aforesaid shall be a good and sufficient discharge for such moneys to the person or persons paying or advancing the same, and he or they shall not be bound or required to see to the application, nor be affected by the misapplication or non-application thereof. TooWOOMBA PATRIOTIC FUND [ASSENTED TO 2ND NOVEMBER, 1914.] ACT OF 1914. r HEREAS in the years one thousand eight hundred Preamble. -W and ninety-nine and one thousand nine hundred a Patriotic Fund was raised in Toowoomba and its district by voluntary contributions in aid of the widows, orphans, and dependants of the Australian Contingent who had been or might be sent to South Africa, or for such other relief as might be necessary: And whereas at a meeting of the subscribers to the said Fund held on the third day of January, one thousand nine hundred, it was resolved that the trustees of the said Fund should consist of the Mayor of Toowoomba, the Manager of the Australian Joint Stock Bank, Limited, at Toowoomba, and the Police Magistrate of Toowoomba, such trusteeship to devolve upon whomsoever should be acting in either of the above positions: And whereas the successor in interest of the aforesaid bank is the Australian Bank of Commerce, Limited, at Toowoomba And whereas the Boer War, in respect of which the said Fund was established, came to an end on or about the thirty-first day of May, one thousand nine hundred and two; and, after making due provision for the purposes for which the said Fund was established, there remains in the hands of the said trustees the sum of one thousand seven hundred and twenty-five pounds or thereabouts: And whereas at a meeting of a committee appointed by and representing the said subscribers held at Too- woomba on the fourteenth day of August, one thousand
