REGULATIONS UNDER THE ROXBY DOWNS

(INDENTURE RATIFICATION) ACT, 1982

1. These regulations may be cited as the Roxby Downs (Constitution of Council)

Regulations, 1986.

2. These regulations shall come into operation on the 26th day of May, 1986.

3. In these regulations—

"the Act" means the Roxby Downs (Indenture Ratification) Act, 1982:

"the Administrator" means the Administrator of the municipal council appointed under the

Olympic Dam and Stuart Shelf Indenture:

"the municipal council" means the municipal council constituted by proclamation pursuant to

the Local Government Act, 1934, and the Act.

4. Notwithstanding any law of the State to the contrary, the municipal council—

(a)

shall be a body corporate with perpetual succession and a common seal;

(b)

shall be capable in its corporate name of acquiring, holding, dealing with and disposing of real and personal property;

and

(c)

shall be capable of acquiring or incurring any other rights or liabilities and of suing and being sued in its corporate name.

5. The Administrator shall exercise all the powers and discharge all the functions of the

municipal council in the name of and on behalf of the council.
