Rottnest Island Amendment Regulations

(No. 2) 2018

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Rottnest Island Amendment
Regulations (No. 2) 2018.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Rottnest Island Regulations 1988.

4.             Regulation 5 amended

In regulation 5(3)(a) delete “domestic commercial vessel or
commercial aircraft, by the operator of the vessel or aircraft”

and insert:

ferry or domestic commercial vessel, by the operator of the ferry
or vessel

5.             Regulation 6A amended

In regulation 6A(1) and (2) delete “vessel or aircraft” and insert:

ferry or domestic commercial vessel

6.             Regulation 7B amended

In regulation 7B(2) delete “applicable aerodrome usage fee

under subregulation (1) or annual payment under

regulation 7C,” and insert:

aerodrome usage fee under subregulation (1),

7.             Regulation 7C replaced

Delete regulation 7C and insert:

7C.	Annual fees for certain aircraft in lieu of admission fees and aerodrome usage fees
(1)	Subject to regulation 7D, the operator of an aircraft in which persons are carried to the Island may pay to the
Authority, in respect of a financial year —

(a)	the annual admission fee set out in Schedule 7 item 5B; and
(b)	the annual aerodrome usage fee set out in Schedule 6 item 2.

(2)	If the operator of an aircraft has paid the annual admission fee and annual aerodrome usage fee under
subregulation (1) in respect of a financial year —

(a)	a person who is carried to the Island in that aircraft during the financial year is taken to have paid the admission fee required under regulation 5; and
(b)	the operator is not required to pay the aerodrome usage fee required under regulation 7B(1) for any occasion during the financial year when the aircraft lands at the Island.

(3) If the annual admission fee and annual aerodrome
usage fee under subregulation (1) are paid during the
financial year to which the fees relate, a reference in
subregulation (1) or (2) to the financial year is to be
read as a reference to the period beginning on the day
on which the fee is paid and ending on 30 June in the
financial year.

8.             Regulation 74B amended

(1)	In regulation 74B(1)(a) delete “7A(1)(b); or” and insert:
7A(3); or
(2)	In regulation 74B(2) delete “7A(1)(b)” and insert:
7A(3)

9.             Schedule 6 amended

Delete Schedule 6 item 2 and insert:

2. Annual aerodrome usage fee (r. 7C(1)(b)) $150.00

10.           Schedule 7 amended

(1)	After the heading to Schedule 7 insert:
[r. 5, 7, 7A, 7C, 20, 22, 26, 30, 31B, 31E and 33]
(2)	In Schedule 7 Part 1 after item 5A insert:
5B.	Annual admission fee for aircraft (r. 7C(1)(a)) $253.00
