Made by the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Rottnest Island
Amendment Regulations 2003.

2.            The regulations amended

The amendments in these regulations are to the Rottnest Island
Regulations 1988*.

3.            Regulation 5 amended

Regulation 5(5)(a) is amended by deleting "6" and inserting instead -

" 4 ,,

4.            Regulation 6 amended and transitional provision

(1) Regulation 6(1)(b)(ii) is deleted and the following subparagraph
is inserted instead -

(ii) in any other case, no later than 7 days

after the last day of each collection period, in respect of fees collected during that collection period.

(2) After regulation 6(1) the following subregulation is inserted -

(la) In subregulation (1)(b)(ii) -

"collection period" means a period of 7 days

commencing on a Wednesday and ending on a

Tuesday.

(3) For the purposes of regulation 6(1)(b)(ii) of the Rotinest Island
Regulations 1988 as amended by these regulations, the period
between the end of the last month immediately before the
coming into operation of these regulations and the first
Wednesday after the coming into operation of these regulations
is taken to be a collection period.

5.            Regulation 6A inserted

After regulation 6 the following regulation is inserted -

6A. Audit of admission fees
(1) The Authority may cause the accounts and records of
admission fees collected by the owner of a vessel or
aircraft who is required to remit admission fees under
regulation 6(1)(b)(ii) to be audited.
(2) An owner of a vessel or aircraft shall not -

(a)

refuse or fail to provide to the Authority, within the time specified by the Authority, accounts and records requested by the Authority for the purpose of an audit under subregulation (1); or

(b)

hinder or obstruct the Authority in the conduct of an audit under subregulation (1).

Penalty: $1000.

6.            Schedule 7 amended

Schedule 7 Part 1 clause 1(c) is amended as follows:

(a) by deleting "6" and inserting instead —

(b)

by deleting "under 12" and inserting instead — " under 13 ";

(c)

by deleting "over 12" and inserting instead — " 13 or more ".
