Rottnest Island Amendment Regulations

1998

Made by the Governor in Executive Council.

1.             Citation

These regulations may be cited as the Rottnest Island
Amendment Regulations 1998.
2. Commencement
These regulations come into operation on 1 July 1998.

3.             The regulations amended

The amendments in these regulations are to the Rottnest Island
Regulations 1988*.

4.             Regulation 14 amended

Regulation 14 is amended by inserting after “secured or
anchored” the following —

unless the person shows to the satisfaction of the

Authority that —

(a)

the person does not have responsibility for the vessel; and

(b)

another person is properly responsible for the vessel

”.

5.             Regulation 20 amended

Regulation 20(11) is amended by deleting “Part VII” and inserting instead —

“ To the extent permitted by law, Part VII ”.

6.             Regulation 22 amended

Regulation 22(5)(b) is amended by deleting “such further time” and inserting instead —

“ further time ”.

7.             Regulation 45 amended

Regulation 45(1)(b) is amended by deleting “the propelled” and inserting instead —

“ be propelled ”.

8.             Regulation 72A amended

Regulation 72A(6) is amended by inserting after “of the Island”
the following —

unless the person shows to the satisfaction of the

Authority that —

(a)

the person does not have responsibility for the vessel; and

(b)

another person is properly responsible for the vessel

”.

9.             Regulation 75 amended

Regulation 75(9) is amended by deleting “ “commencement” the” and inserting instead —

“ “commencement” means the ”.

10.           Schedule 7 amended

(1) Part 1 of Schedule 7 is amended —

(a)

in item 1 by deleting “$4.50” and inserting instead — “ $6.50 ”;

(b)

in item 2 by deleting “$40” and inserting instead — “ $60 ”.

(2) Part 2 of Schedule 7 is amended by deleting item 4 and inserting
instead —
4. Annual mooring site licence fee $500, or $50 per metre
(regs. 22(3)(b), 33(3)(b), of length of licensed

35D(4)(b))

vessel or vessel to be licensed, whichever is the greater amount

”.
