[ASSENTED TO 20TH DECEMBER, 1946.1 d, W s HEREAS about the year one thousand nine Preamble. bin- the "RhousnadlireedScahnodotlwoefnAtyr-tesiganhdt aCnoImnsmtietumtioornatkionnowHnalals" was established, the principal objects of which Institution ordne, being— (a) The establishment and maintenance of a te School of Arts, in a building to be erected in commemoration of those of the district who d, enlisted and served in the Great War, one or thousand nine hundred and fourteen to one 7, thousand nine hundred and eighteen; otef (b) TGhyemneasstiaubml,iRsheamdienng-trooofma, LPiburbarlyic, CHlaasslels, for Instruction in Useful Knowledge, and for such other purposes as the committee for the time being of thc said Institution should decide on: AND WHEREAS pursuant to and for the purposes of its objects the said Institution acquired and now owns property including the freehold lands described in the Schedule to this Act, and has established upon such Schedule. lands a School of Arts: AND WHEREAS the estate in fee-simple in the said lands is presently, by Nomination of Trustees Number A18171 and Deed of Appointment of a new trustee, vested in Archibald Watson, the Honourable Edward Michael Hanlon, and Robert Alfred Alexander as trustees for and on behalf of the said Institution upon and with and subject to the limits, powers, and conditions set out in the Schedule of Trusts to the said Nomination of Trustees: AND WHEREAS the said the Honourable Edward Michael Hanlon is presently the sole survivor of the aforementioned three trustees :

Imperial League of Australia" upon the trusts for which Schedule, the said Sub-Branch may hold lands and other property under and subject to the constitution, rules and by-laws of the said League, but absolutely freed and discharged from the trusts upon and subject to which such lands and other property have heretofore been held. (2.) The Honourable Edward Michael Hanlon, the sole surviving trustee of the lands described in the Schedule to this Act may (and he is hereby authorised to)— (i.) Have the deaths of the deceased trustees of the lands described in the Schedule to this Act recorded upon the respective certificates of title therefor; and (ii.) By a nomination of trustees duly made and executed in accordance with the provisions of *" The Real Property Acts, 1861 to 1942," transfer to the trustees of the Ithaca Sub- Branch of "The Returned Sailors, Soldiers, * 25 V. Rosalie School of Arts, Etc., Act. 425 and Airmen's Imperial League of Australia" all his estate or interest in the said lands to be held by such lastmentioned trustees upon the trusts for which such Sub-Branch may hold lands and other property under and subject to the constitution, rules, and by-laws of the said League, but absolutely freed and discharged from the trusts upon and subject to which such lands has heretofore been held. 3. Any property which is vested in the said Sub- Trustees to Btoraanncyhdbeybtv,ilritaubeiloiftyth, iosrAocbtlisghaatlilobnesspoecvieasltleydcshuabrjgeecdt s m tau o bk r ej t e g ica a tn g t e do , on or affecting the same and in particular the trustees 8'. of the said Sub-Branch shall take and hold the said lands subject to the existing registered bill of mortgage thereover in favour of the Public Curator of Queensland, and the liability of the said Institution in respect of the unpaid amount of such mortgage debt together with all interest heretofore accrued due thereon and not duly paid or hereafter to become due and payable thereon shall be imposed upon and be discharged by the said Sub-Branch. On and after the passing of this Act neither the said Institution nor the said the Honourable Edward Michael Hanlon shall be subject to any liability in respect of any debt, liability or obligation hereinbefore in this section mentioned. SCHEDULE. All that piece or parcel of land situated in the county of Stanley, parish of Enoggera, described as subdivision 221 of portion 225, containing an area of 16 perches (be the same a little more or less), being the whole of the land contained in Certificate of Title No. 68305, volume 467, folio 35. All that piece or parcel of land situated in the county of Stanley, parish of Enoggera, city of Brisbane, described as resubdivision 1 of subdivision 222 of portion 225, containing an area of 15.82 perches (be the same a little more or less), being the whole of the land contained in Certificate of Title No. 350311, volume 1864, folio 51. All that piece or parcel of land situated in the county of Stanley, parish of Enoggera, city of Brisbane, described as resubdivision 1 of subdivision 223 of portion 225, containing an area of 12.91 perches (be the same a little more or less), being the whole of the land contained in Certificate of Title No. 350312, volume 1864, folio 52.
