CaseChat Overview and Summary

The Rookwood General Cemeteries Reserve Trust, trading as Rookwood General Cemetery, applied for the approval of the Rookwood General Cemeteries Reserve Trust Enterprise Agreement 2016. The matter was heard in the Fair Work Commission. The trust sought to have the agreement approved under section 232 of the Fair Work Act 2009. The agreement was to apply to the employees of the trust who were members of the Australian Licensed Aircraft Technicians' Association.

The central legal issue before the Commission was whether the proposed enterprise agreement complied with the relevant provisions of the Fair Work Act. Specifically, the Commission needed to determine if the agreement provided for the employees' wages and conditions of employment in a fair and reasonable manner. The Commission also had to consider if the agreement was in the best interests of the employees and the trust.

The Commission found that the proposed agreement met the necessary criteria. It provided for fair and reasonable wages and conditions, taking into account the specific circumstances of the employees and the trust. The agreement also included appropriate mechanisms for dispute resolution and the protection of employee rights. The Commission concluded that the agreement was in the best interests of both the employees and the trust, and approved it under section 232 of the Fair Work Act.

The Commission's decision was that the Rookwood General Cemeteries Reserve Trust Enterprise Agreement 2016 be approved. This decision was made in the interest of ensuring fair and reasonable terms and conditions of employment for the employees of the trust, while also supporting the operational needs of the trust.
