Application for approval of the Rookwood General Cemeteries Reserve Trust Enterprise Agreement 2013.

[1] An application has been made for approval of an enterprise agreement known as the Rookwood General Cemeteries Reserve Trust Enterprise Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The agreement is a single enterprise agreement.

[2] An application was filed at the same time by the Rookwood General Cemeteries Reserve Trust (the Applicant) for an order in relation to transfer of business pursuant to s.318 of the Act (AG2013/1316).

[3] These two applications were heard together on Wednesday, 12 June 2013.

[4] The s.318 application is dealt with in decision [2013] FWC 3639 (PR537646) which sets out the background to both applications.

[5] I am satisfied that each of the requirements of ss186, 187 and 188 as are relevant to this application for approval have been met.

[6] An undertaking has been provided by the Applicant. The Funeral and Allied Industries Union of New South Wales (the Union) concurs with the undertaking given. The Fair Work Commission notes and accepts the undertaking provided by the employer and it is taken to be a term of the Agreement. A copy of the undertaking is attached to this decision as Annexure A.

[7] The Union, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. As required by s.201(2) I note that the Agreement covers the organisation.

[8] I indicated at the hearing that the Agreement would be approved on that date, 12 June 2013. In accordance with s.54(1) it will operate from 19 June 2013. The nominal expiry date of the Agreement is 18 June 2016.
