No. 27, ( 3. ) Where an offence against subsection one of this section is committed in relation to any roofing tiles manufactured in Queensland by a person other than the manufacturer of those roofing tiles, then that manufacturer shall also be deemed to have committed that offence and he shall be liable to be charged with that offence and convicted thereof accordingly. ( 1. ) A manufacturer of roofing tiles- ( a) Shall before supplying any roofing tiles manufactured by him make ; and (b) Shall at all times during the period of two years next succeeding the supplying of those roofing tiles keep, a record of the transaction showing the following particulars in respect thereof, that is to say : - (i.) The date of the transaction ; (ii.) The name, place of abode or business, and occupation of the other party to the transaction ; (iii. ) The type and number of the roofing tiles required to be supplied ; (iv.) Where those roofing tiles are to be supplied in pursuance of a contract of work, labour and materials, the address of the place at which the building the subject of that contract is situated, and the name and address of the owner of that bµilding ; and ( v. ) Such other particulars, if any, as may be prescribed. rktrRehoeesopepcftoisenraicgndtletotiofolefbs. e tiles) (2w. ROOFING TILES. 371 1949. Roofing Tiles Act. ( 3. ) Any offence against this Act may be prosecuted in a summary way under * " The Justices Acts, 1886 to 1946, " upon the complaint of an inspector or other person authorised by the Minister. ( 4. ) A prosecution for any of the offences under this Act may be instituted within twelve months after the offence was committed or within six months after the discovery of the offence, whichever is the later period. ( 5. ) Where an offence against this Act is committed by a person acting or held out as acting in the course of his employment by another person, that other person shall be deemed to have committed that offence and shall be liable accordingly : If a person fails to comply in any respect with a lawful order, direction or requirement of an inspector or other officer, that inspector or officer may do all such things and take all such steps as he deems necessary to effect the purpose of that order, direction or requirement. Provided that this subsection shall apply so as not to affect or limit in any way the liability of the person who actually committed the offence. ( 6. ) If roofing tiles which do not comply in every respect with the requirements ofthe standard specification therefor are supplied or sold to a person in Queensland from elsewhere than in Queensland, then any person in Queensland who acts or who holds himself out as acting in the transaction or sale as the agent of the supplier or seller outside Queensland shall be deemed to have made that transaction or sale as a principal party thereto and shall be liable accordingly as if that transaction or sale had been made by him in Queensland. Evidence. 2 1 . ( 1. ) The burden of proof that any tiles are not roofing tiles shall in every case be on the defendant. ( 2. ) Where a standard specification for any type of tiles is prescribed under this Act, any and every tile of that type shall be presumed to be a roofing tile under and within the meaning of this Act until the contrary is proved. ( 3. ) A certificate purporting to be under the hand of the Officer- in- Charge of Roofing Tile Testing stating that an amount set out therein is due and payable by a person named therein in respect of any specified fee payable under this Act or in respect of any charges and expenses duly incurred by an inspector under this Act and that such amount has not been duly paid shall, upon its production in evidence, be evidence of the matters certified to therein, and in the absence of evidence in rebuttal thereof shall be conclusive evidence of such matters. ( 4. ) Any document signed by an inspector which purports to be a duplicate or copy of an order made under this Act shall upon its production in evidence be evidence of the order of which it purports to be such duplicate or copy, without any proof that such duplicate or copy was compared with the original thereof and without any notice to produce such original. Moreover, all costs and charges incurred for handling, storing, and/or otherwise dealing with any roofing tiles that do not comply in every respect with the requirements of the standard specification for those roofing tiles consequent upon the seizure and detention thereof under this Act shall be payable by the owner and, if not paid upon demand, recoverable from him as a debt. ( 3. ) Any condition implied by virtue of this section shall be in addition to any condition or warranty expressed or implied by law. ( 4. ) Subject to subsection five of this section, any covenant, agreement, or condition expressed or implied in a contract or agreement or in a separate document whereby it is agreed between the parties to that contract or agreement that a condition implied by this section in relation to any roofing tiles shall not be legally binding as against the seller or contractor shall be absolutely void and of no legal effect whatsoever. ( 5. ) A condition by this section implied in any contract or agreement in relation to roofing tiles may be waived by a party ( other than the contractor) to such contract or by the purchaser, or such party or purchaser may elect to treat the breach of such condition as a breach of warranty and not as a ground for treating the contract, agreement, or sale as repudiated.

Cement.-The cement used in the manufacture of the tiles shall comply with the requirements of the standard approved for the time being by the association known as Standards Association of Australia and contained in Australian Standard No. A. 2-; Portland Cement and High Early Strength Portland Cement. 3. Aggregate.-The aggregate shall consist of clean, hard particles of mineral origin and shall be free from- (a) Harmful organic impurities ; (b) Clay, except where present in a finely divided state and then not more than five per cent ; ( c) Sea-shell fragments, whether larger or smaller than the maximum-sized particles of other aggregates ; and Th ( e d) mSaaxltims, uamcidssi, zeoroofthtehre hcaornmsftuitluceonmt ppoaurntsdso. f the aggregate shall not exceed one-half the minimum thickness of the tile. 4. Pigment.-Any pigment incorporated in the body or the surface coating of the tiles shall comply with the requirements of the standard approved for the time being by the association known as Standards Association of Australia and contained in Australian Standard No. K. 54, Colour Pigments for Use with Portland Cement. 5. Colo,ur.-Cement and pigment used for colouring tiles shall be thoroughly intermixed in a suitable type of ball, blade, or colloid mill. 6. Wnrkmanship and Finish.-All tiles shall be of regular shape, smooth, thoroughly compacted, sound, and shall interlock properly when laid on a roof. The surface finish shall be dense and shall be free from pitting, scoring, and irregularities. Any distortion, in relation to the points of support, shall not when measured in relation to a plane exceed one-sixteenth ( 1/ 16) part of an inch.

The wiring hole shall be not less than one- quarter ( 1/ 4) of an inch from the outer edge of the lug, except that in the case of metal lugs the hole shall be not less than one­ eighth ( 1/ 8) of an inch from the outer edge of the lug. Where metal lugs are used for wiring, they shall be corrosion-resistant. 12. Nail Holes.- In the case of tiles without weathering check, as an alternative to the provision of a wiring hole, each tile shall be provided with a nail hole in the central rib. The centre of the nail hole shall be not less than five-eighths ( 5/ 8) of an inch, nor more than seven-eighths (7 / 8) of an inch from a line joining the base of the batten lugs. The nail holes shall be not larger than one- quarter ( 1/ 4) of an inch nor smaller than three­ sixteenths ( 3/ 16) of an inch in diameter. 13. Ji'ittings.-Hip tiles, ridges, verge, apex, and other special tiles shall conform to the standard quality for the tiles with which they are to be laid and shall be free from incipient cracks in the vicinity of the internal angle. Hip tiles and ridges shall be not less than one- half ( 1/ 2) an inch thick, nor more than twenty (20) inches long, and shall have an internal horizontal span of not less than six and one-half ( 6 1/ 2) inches. The end flange cover of these : fittings shall be not less than one ( 1) inch. 14. Branding.-At least five per cent. of tiles manufactured by equipment installed prior to the seventeenth day of May, one thousand nine hundred and forty-eight shall be clearly and permanently branded with the manufacturer' s name or trade mark registered under the *Trad,e Marks Act 1905- 1948 of the Commonwealth. The method of carrying out the transverse breaking test of tiles shall be as follows : - ( a) Test Specimens : Six tiles shall be tested in order to determine the transverse breaking strength. * No. 20 of 1905 of the Commonwealth and amending Acts.
ROOFING TILES. 1949. Roofing Tiles Act. ( b) Procedure : The six tiles shall be immersed in water at room temperature for a period of twenty-four hours and immediately tested wet in the following manner : - A batten two ( 2) inches wide and notless than one ( I) inch thick shall be placed under the tile and against the batten lugs in a position similar to that which the batten will occupy in relation to the tile in use. The supporting nibs shall be made to rest on the centre of a similar batten. With the tile thus supported in a horizontal position on the two battens, the load shall be applied along the width of the tile through a third batten two ( 2) inches wide, placed midway between and parallel to the supporting battens. The batten through which the load is applied shall be separated from the tile by a layer of felt one­ quarter ( I/ 4) of an inch thick. The load shall be applied by increasing the dead load of a container by adding fluid or shot at a uniform rate of one hundred to one hundred and fifty pounds per minute until failure occurs. ( c} Test Result : The actual breaking load of each of the six tiles tested shall be separately recorded and the average of these breaking loads shall be taken as the average transverse strength. 16. Water Absorption.-The percentage of water absorption when determined in the manner described in this clause shall not average more than ten per cent. ( 10% } for the tiles tested. The method for the determination of water absorption of tiles : shall be as follows :- ( a) Test Specimens : The portions of the six tiles fractured in the transverse breaking test shall be tested in order to determine the water absorption. ( b} Procedure : Immediately following the transverse breaking test the fractured halves, or major portions thereof, of the six saturated tiles which have been broken shall be weighed in such a manner as to give an individual weight with relation to each of the six tiles under test. Should only one of the tiles tested fail to comply with the above requirement, the test shall be repeated on three further tiles selected from the same lot as that from which the original tiles tested were 379

If each of the three additional tiles tested complies with the permeability requirement specified above, the lot shall be considered to have passed the test. The method of carrying out the permeability test of tiles shall be as follows :- Three tiles shall be tested as set out below :- A metal frame shall be fitted around the perimeter of each tile tested and shall extend from one-quarter ( 1/4) of an inch below the underside of the tile to not less than two ( 2) inches above the invert of the main watercourse. The frame shall be attached to the edges of the tile in such a . manner as to form a watertight seal. This shall be accomplished by means of a waterproof sealing agent, care being taken that the front face of the weathering check and the inverts of the side water channels are not sealed . The person making the test shall satisfy himself that the seal is watertight before proceeding with the test. The tile, sealed in the frame, shall then be supported topside uppermost in a horizontal position on impervious supports, care being taken to see that the body ofthe tile is not in contact with the supports. The supports shall be at a convenient height for making observations of the underside of the tile. A two ( 2) inch head of water, measured from the invert of the main watercourse, shall be maintained on the tile for a period of twenty-four hours. If necessary, water shall be added during the test to maintain the requisite head. 18. 1949. ROOFING TILES. Roofing Tiles Act., 381 PART II. Standard Specification for Terra Cotta Roofing Tiles. [ s. 7 ( 2) . J 1. Scope. -This specification applies to tiles made from burnt clay or shale for roofing purposes and comprised within one or other of the following types : - ( a) French (Marseilles) pattern tiles, ( b) Shingle tiles, ( c) Latin tiles (sometimes known as Roman, Italian, or Spanish) , interlocking or otherwise. 2. Dimensions.- (a) The dimensions of French pattern tiles shall be such that the maximum batten length measured on an average of five tiles does not exceed thirteen and seven-eighths ( 13 7/8) inches, the main side lap shall be not less than one and one-half (1 1/ 2) inches wide, the main side course not less than one- eighth ( 1/ 8) of an inch deep, and the subsidiary side courses not less than three- thirty- seconda (3/32) of an inch deep. The depth of weathering at the head, measured on the centre of the width of the tile, shall not be less than five-eighths ( 5/ 8) of an inch. Batten lugs shall project not less than one- quarter ( 1/ 4) of an inch. ( b) The overall length of a shingle tile shall not exceed ten and one- quarter ( 10 1/4) inches. The batten lugs shall be continuous and shall not project less than three- eighths ( 3/ 8) of an inch. The thickness of the tiles shall be not less than three-eighths ( 3/ 8) of an inch. Two nail holes shall be provided not less than two ( 2) inches from the centre and at five-eighths ( 5/ 8) of an inch from the bottom of the batten lugs. ( c) Ridges and hips for French pattern and shingle tiles shall not exceed twenty ( 20) inches in length. The flange cover shall be not less than one ( 1) inch and the side cover not less than four and three- quarters (4 3/ 4) inches measured on the inside. 3. Workmanship and Finish.-Tiles shall be sound and of regular shape and neat finish. The water courses in French pattern tiles shall be clear and well defined. Distortion on a twisted or cambered tile shall not exceed three- sixteenths ( 3/ 16) of an inch measured as the distance of any point on the face ofthe tile from a flat surface on which it rests. Wiring lugs shall be adequately pierced and batten lugs shall be well formed, and so as to effectively engage the batten. 4. Transverse Strength.-The transverse breaking strength of tiles when tested in the manner prescribed in clause seven shall be not less than two hundred and seventy-five ( 275) lbs. for French pattern tiles and Latin interlocking tiles and twenty-five ( 25) lbs. per inch of width for shingle tiles determined as the average of the tiles tested.

Selection of Tiles for Testing.-Six tiles shall be taken at random from the lot for any one test and the average figure for these tiles shall be regarded as the result of the test. Tiles for testing shall be in a dry condition. ' i. Transverse Test.-The test for transverse breaking strength shall be carried out as follows :- A one and a-half (1 1/ 2) inch batten shall be placed under the tile behind the lugs in a position similar to that which the batten would occupy in relation to the tile in use, and the nose of the tile shall rest on a similar batten. The pressure shall then be applied across the tile midway between and parallel to the supporting battens and through a one and a-half (1 1/ 2) inch batten separated from the tile by a one-eighth ( 1/ 8) of an inch thickness of felt. 8. Absorption Test.-A tile in dry condition shall be broken and the pieces weighed, immersed in water for twenty-four hours, removed from the water, hand dried with a towel and immediately weighed. ·The percentage increase in weight, calculated as the difference in weight divided by the original weight shall be the percentage of absorption. 9. The term " lot. "-The term " lot " shall mean and include : - ( i. ) The whole of the tiles situated at any particular place at the time of inspection and examination of tiles at that place or such portion of such tiles as shall be defined by the inspector as represented by the selected test specimens ; and (ii. ) Where tiles are produced by continuous production methods, the whole output of the plant on the day or days when the selected test specimens were made.
