Land in the Shire of Coorparoo, given and TRCHATRHOOMLAICN devised as a Site for the Erection of a Roman LACNHDUSRACLHES ACT 01'1913. Catholic Church, to Sell the Same and Apply the Proceeds towards the Purchase of another Site in a more convenient situation. [ASSENTED TO 15TH SEPTEMBER, 1913.] W HEREAS by the Will of James Toohey, late of Prembie. Mount Galway, Logan road, South Brisbane, in the State of Queensland, dated the twentieth day of November, one thousand eight hundred and eighty-three, the said James Toohey devised to the Roman Catholic Bishop for the time being of the Diocese of Brisbane and the officiating Catholic Priest for the time being for the Parish of South Brisbane one acre of land, being part of portion one hundred and seventy-four, Parish of South Brisbane and county of Stanley, to be held by them as Trustees upon trust as a site for a Roman Catholic Church, such portion of land to be described and the site selected by Anne Toohey, Thomas Burke, and William Smith, the 'Trustees of his Will:

Toohey died on the. twenty-second day of November, one thousand eight. hundred and eighty-three, and Probate of his Will was,. on the eighteenth day of January, one thousand eight hundred and eighty-four, granted to the said Anne Toohey, Thomas Burke, and William Smith, the executors named in the said Will: And whereas the said Anne Toohey, Thomas Burke, and William Smith 'duly described and selected subdivision five of the aforesaid portion and transferred the same to. Robert Dunne, then being the Roman Catholic Bishop of the Diocese of Brisbane, and to Phillip Corrigan, then being officiating Catholic Priest of the Parish of South Brisbane, as joint tenants; and Certificate of Title No. 97114 was issued to the said Robert Dunne and Philip Corrigan as registered proprietors; and the said Robert Dunne and Philip Corrigan still hold the said land upon the trusts aforesaid: And whereas it is expedient that the said Trustees should be empowered to sell and dispose of the whole of the said land, and to use the proceeds of such sale towards the purchase of a more convenient portion of land: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same as follows:- Short title. 1. This Act may be cited as " The Roman Catholic Church Land Sales Act of 1913." The Trustees are hereby empowered to sell sub- cexhiusrtcinhgsite. division five of portion one hundred and seventy-four, parish of South Brisbane and county of Stanley, described in Certificate of Title No. 97114, containing one acre, and on payment of the purchase money the Trustees shall transfer the said land to the purchaser, and such transfer shall be valid and effectual for all purposes whatsoever, and shall confer upon the purchaser a title free from encumbrance or any trust.
