Roluke Pty Ltd v Lamaro Consultants Pty Ltd (No. 2)

Roluke Pty Ltd and others (the plaintiffs) appealed to the New South Wales Court of Appeal against a judgment of Nicholas J concerning damages awarded in a principal judgment. The dispute related to the reassessment of damages and associated costs.

The Court of Appeal was required to determine whether the quantum of damages awarded by the primary judge was correct and, consequently, to consider the appropriate orders regarding the costs of the appeal.

The Court allowed the appeal in part, finding that the damages awarded by Nicholas J on 18 May 2007 required adjustment. In lieu of the original judgment, the Court entered judgment in favour of the plaintiffs for the sum of $1,257,448. The respondents were ordered to pay two-thirds of the appellants' costs of the appeal.
