3 Rockhampton Port Authority Amendment (No. 1) No. 86, 1992 ˙ Short title 1. This by-law may be cited as the Rockhampton Port Authority Amendment By-law (No. 1) 1992 . ˙ Amended by-law 2. The Rockhampton Port Authority By-law 1987 is amended as set out in this by-law. ˙ Amendment of heading before s.7.1 3. Before section 7.1— omit ‘ CONTROL OF THE CARGO OF VESSELS, AND DUES, RATES, FEES AND CHARGES, INCLUDING HARBOUR DUES ON GOODS AND TONNAGE DUES ON VESSELS ’, insert ‘HARBOUR DUES AND CONTROL OF CARGO’. ˙ Amendment of s.7.5 (Tonnage rates—amount payable) 4. Section 7.5(i)— omit ‘ the provisions of Schedule “A” hereto ’, insert ‘ Schedule 1 ’. ˙ Amendment of s.7.8 (Definitions) 5. Section 7.8— insert — ‘ “explosive” has the meaning given by section 8 of the Explosives Act1952 ; “meatworks products” includes preserved and frozen meats, dripping, tallow and hides; ’. ˙ Amendment of s.7.10 (Import harbour dues) 6.(1) Section 7.10(i)— omit ‘ Schedule “B” hereto ’, insert ‘ Schedule 2 ’.

(2) Section 7.11(ii)— omit ‘ Schedule “C” hereto ’, insert ‘ Schedule 3 ’. ˙ Replacement of s.7.12 (Transhipment harbour dues) 8. Section 7.12— omit, insert— ˙ ‘Transhipment harbour dues ‘7.12 Transhipment harbour dues are payable on all goods transhipped within the harbour at the rate of $0.27 per tonne or per cubic metre, whichever is the greater. ’. ˙ Amendment of s.7.14 (Harbour dues on goods—how assessed) 9. Section 7.14(ii)— omit . ˙ Amendment of s.7.16 (Harbour dues on empty cargo-carrying units, flats or pallets) 10. (2) Section 7.31(ii)— omit ‘ Schedule “B” ’, insert ‘ Schedule 2 ’. ˙ Omission of schedules after s.7.31 13. Schedules “A”, “B” and “C” after section 7.31— omit. ˙ Insertion of new schedules 1, 2 and 3 14. After section 9.7— insert — ‘SCHEDULE 1 ´ ‘TONNAGE RATES section 7.5 Tonnage rates are— (a) for a vessel of 150 gross registered tons or more— (i) for the first day or part of a day—$0.17 per ton; and (ii) for each subsequent day or part of a day—$0.15 per ton; and (b) for a commercial vessel of less than 150 gross registered tons—$21.90 per ton per day or part of a day.
