(Amendment No 15)

under the

Environmental Planning and Assessment Act 1979

The Greater Sydney Commission makes the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Rockdale Local Environmental Plan 2011 (Amendment No 15).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to all the land to which Rockdale Local Environmental Plan 2011 applies.

4      Maps

The maps adopted by Rockdale Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the Greater Sydney Commission on the making of this Plan.

Schedule 1

Amendment of Rockdale Local Environmental

Plan 2011

[1]      Clause 1.2 Aims of Plan

Omit “Rockdale” from clause 1.2 (1).

Insert instead “that part of the Bayside local government area to which this Plan applies (in this Plan referred to as Rockdale)”.

[2]      Land Use Table

Omit “Correctional facilities;” from item 4 of Zone B4 Mixed Use.

Insert instead “Correctional centres;”.

[3]      Clause 5.1A Development on land intended to be acquired for public purposes

Omit the following from the Table:

Note. In determining an application for a modification of a development consent granted under this clause, the consent authority must again take the requirements of this clause into consideration (see section 96 (3) of the Act).

[5]      Clause 6.14 (3) (b) and (c)

Omit clause 6.14 (3) (b). Insert instead:

(b)

the design of the development is the winner of the architectural design competition, and

(c)

the consent authority considers that the development exhibits design excellence.

[6]      Clause 6.14 (4)

Omit the subclause. Insert instead:

(4)

An architectural design competition is not required under subclause (3) if the

consent authority is satisfied that:

(a)

such a process would be unreasonable or unnecessary in the circumstances, and

(b)

the development exhibits design excellence.

[7]      Clause 6.14 (6), definition of “Design Excellence Guidelines”

Omit “Rockdale Local Environmental Plan 2011 (Amendment No 8)” from the definition.

Insert instead “Rockdale Local Environmental Plan 2011 (Amendment No 15)”.

[8]      Schedule 1 Additional permitted uses

Insert at the end of the Schedule, with appropriate clause numbering:

Use of certain land at 50 Park Road, Sans Souci

(1)

This clause applies to land at 50 Park Road, Sans Souci being Lot 1,

DP 1152183.

(2)

Development for the purposes of a registered club or a restaurant or cafe is

permitted with development consent.

Use of certain land at 55 Sanoni Avenue, Sandringham

(1)

This clause applies to land at 55 Sanoni Avenue, Sandringham being Lot 436,

DP 752056.

(2)

Development for the purposes of a registered club or a restaurant or cafe is

permitted with development consent.
