Queensland Robertson Park Trust Variation Act 1991 Act No. 46 of 1991 An Act to free certain land vested in the Brisbane City Council from a trust for the purpose of dedicating the land as road [Assented to 28 August 1991]
2 Robertson Park Trust Variation No. 46, 1991 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. Short title 1. This Act may be cited as the Robertson Park Trust Variation Act 1991 . Interpretation 2. In this Act— “Council” means the Brisbane City Council; “excised land” means the land described in the Schedule. Discharge from trust 3.(1) The excised land is discharged from the trust for park purposes to which it was subject before the commencement of this Act. (2) Subsection (1) does not affect the ownership of the excised land by the Council. Dedication as road 4. As soon as is practicable after the commencement of this Act, the Council is to— (a) lodge for registration in the office of the Registrar of Titles a plan of survey dedicating the excised land as road; and (b) carry out on the excised land, and on road abutting the excised land, such works as it considers necessary or desirable to enable the excised land to be used as road. SCHEDULE section 2 EXCISED LAND Area: Real Property Description: County: Parish: about 86 square metres part of lot 131 on RP 49358 contained in certificate of title volume 2397 folio 219 Stanley Indooroopilly Metes and bounds description— Its boundaries start at the southeastern corner of lot 131 and run westerly by the northern alignment of Lambert Road bearing 278˚30' for a distance of 10 metres, then northeasterly by a line bearing 41˚32' for a distance of 17.48 metres, then northerly by a line bearing 22˚02'20" for a distance of 6.5 metres to the western alignment of Indooroopilly Road and then southerly by that western alignment bearing 191˚22' for a distance of 21.0 metres to the start.
