1. The applicant requires an extension of time within which to seek special leave to appeal from the whole of a judgment of the Full Court of the Federal Court of Australia (Perram, Katzmann and Kennett JJ) which dismissed an interlocutory application filed by the applicant seeking leave to file an amended notice of appeal and an alternative order.

2. The application for special leave raises no question of legal principle and the proposed appeal has insufficient prospects of success. It would therefore be futile to grant the extension of time sought.

3. Special leave to appeal is refused with costs.
