CaseChat Overview and Summary
The central legal issues for the FWC to determine were whether the proposed agreement complied with the statutory provisions regarding good faith bargaining, and whether the agreement was fair and reasonable. Specifically, the FWC needed to ensure that the agreement did not adversely affect the employees' wages and conditions beyond what was necessary for the operation of the business and that it provided a fair and reasonable outcome for both parties.
The FWC found that the agreement met the legal requirements for approval. The commission noted that the parties had engaged in good faith bargaining, and the terms of the agreement were fair and reasonable. The FWC concluded that the proposed agreement did not adversely affect the employees' wages and conditions beyond what was necessary for the operation of the business. The FWC also found that the agreement provided a fair and reasonable outcome for both parties.
The FWC approved the Robert Lange Engineering Pty Ltd and AMWU Agreement - 2019-2021, and the final orders were issued accordingly.
